if the house is in the wifes name, can a claim be made on it, if its the husband in debt

Hi Andy

It would all depend on the circumstances

There are numerous issues to be addressed only some of which are
- did the wife own the house prior to marriage
- who paid the deposit
- who has paid the mortgage
- has the husband contributed to improvements/maintenance of the property

The OR/trustee will look very closely at the history of the ownership of the property and the financial circumstances of the husband and wife in order to determine whether or not to make a claim to some of the equity

The short answer is to seek advice from one of the experts on this site (or elsewhere) if you have any concerns

Just to add that if the property is in negative equity then the OR won't be interested in it so the points from Bridgewood will only apply if there is equity in the property.
