I have been in a relationship for a good number of years. Not Married. I have not contributed to very much. House in his name. I am on invalidity benefits.

We are going to go our separate ways, and I am going to go bankrupt. From all accounts I am a boarder in his house. My own room room.

Years ago we did open a bank account in joint names. My name comes first on the bank statement. I do not use this account. It is use solely by my partner – it is his main bank account and he is in full employment. We have always kept out money affairs separate.

“The Official Receiver will need to establish the details of all bank
accounts and credit cards held by you either solely or jointly. Full
details of all accounts and credit cards held by you either solely or
jointly in the last two years should be provided.”

What to do? Can we write to the bank and ask for my name to be taken off the bank account and then leave out these details out of my declaration.

I am desperate to keep his name out of any of this mess.

Your comments appreciated.

Hello there Oracles

Ignoring "leave out these details out of my declaration."

What can happen to this bank account? ie my ex-partners money when I go bankrupt?

Although he is supportive of my efforts to get a life, he is (we both are) naturally feeling anx about this matter now.

Many thanks

You will need to declare this account on the SOA but you can ask the bank to remove your name from the account so it can remain open after you have been declared BR.

hello gettingoutofdebt

Many thanks for your reply. We have written to the bank re removal of my name today.

Do you think the receiver will want to investigate this account ie my ex partners finances. (NB: His financial affairs as straight as a dye).

Thanks

The OR may have a look at the account just to check that you are not hiding any money from your creditors but that will probably be about it.
