I am preparing to go bankrupt at Walsall County court next month.Does anyone know the procedure there.Also although it is a personal bankruptcy I am a self-employed decorator.Will that make things more complicated?

Hi there, the proceedure at Court will be the same whether or not you are employed/unemployed or self employed. The courst role is purely to 'make' the order, the difference occurs with the Official Receiver who may hold a face to face meeting as opposed to a telephone meeting as you are 'self employed'

As to the proceedure on the day, it is down the individual court, you may have your forms taken off you, (with the fee) and told to take a seat (be prepared for a long wait!) following which the clek will return hand you a copy of the forms and inform you that the Official Receiver will be in touch, to make an appointment. Some courts will put you on the phone to the OR at the court offices to make the appointment. Be prepared that at some courts you may be taken in to see the district Judge who will make the bankruptcy order, don't be put off by this, it is not open court, more often than not this is done in 'chambers' which is basically a room with a desk. The district judge will ask you to confrim your name, ask whether or not you have taken advice etc and then 'make the order'

Although i appreciate the whole process appears dauting and scary, it really is straight forwrad. The courts are there basicially to action the actual bankruptcy order, they will not deal with queries etc and you do not need to have any paperwork etc with you other than the bankruptcy forms. it is the official receiver who will go through the whole process with you and require documentation etc and be able to deal with any concerns you may have. (Don't be suprised if you come away from the court feeling a little deflated, having built it up in your mind to be a massive event, only to have had forms taken off you and then returned to you once the order has been made) You will feel incredibly relieved though!

Hi Julie

This is one of the most efficient courts to complete your bankruptcy process. Try and get a 9.15am appointment the main court office is closed but the security man lets you in he has a list. You go to the counter are seen very promptly by a very friendly clerk who checks your forms and takes your fee, you are then and imediately taken down to the Judges waiting area, ( Many other courts keep you waiting at this point) the Usher takes your file straight in and comes out with it done nine times out of ten without you seeing him. You are sent straight back to the office where your order is given to you with a receipt and copy of your papers. You will be out by 10am al done if only the process was the same at all courts, hope that helps.

Thanks very much Melanie and Daniel for your helpful replies.I have my final meeting with the CAB in an hour to go through my papers and book the court.I would be feeling so much worse if it was not for these forums.I have been reading them and preparing myself for this for a few months now.I have got myself used to the idea so it will not be as big a trauma.I have set up my Coop account with benefits going in and important DDs going out.I have cancelled my debt DDs and a coupkle of months ago I changed my phone number so they cannot ring me.This has also given me an excuse to contact all past customers to give new number so hopefully some more work there(already got 2 extra jobs from that)Got 3 letters from creditors but very mild as I have been such a good customer,never defaulting or paying late.They have made so much out of me in interest and Bal Trans charges!!Have also got my fee money and am trying to use only cash now to get used to it.Will let you know how I go at court etc.Many thanks,Julie
