 Renting before declaring BR

I'm a little bit confused about the issue of renting a property. My house is in negative equity and following a seperation can not meet the mortgage payments so am happy to leave the property. I have found a property to rent which is all going through at the moment as i was advised to do this before starting BR proceedings. I am currently 1 year into an IVA but that was set before my seperation. The question i have is do i list my mortgage payment and my rent on the BR forms? Also, i haven't contacted my mortgage company yet, do i tell them when i've left the property?
Also (sorry) I need to apply for housing benefit towards my rent but there is a question do you own a property? In theory i do but won't eventually, do i state that i do and will this prevent me getting the benefit?

Hi New start

welcome to the forum, sorry to read about your plight

1) speak to your IVA provider what can they do to help ?
2) you going BR will also have an effect on ex, if you are still speaking make ex aware of plans, noth really need time to plan BR
3)you must wait three months of non payment to get a certificate of failure
4)Do not rush to move out of residential property, use the rent free and mortgage payment free period to fund your bankruptcy and if appropriate expert advice.(i would recomend a call to an expert )
5)visit the local council and ask to speak to the on call/ duty housing officer
