Hi everyone,
I nearly have enough money to declare bankrupt and I am hoping to do it next week.
I am actually having a bad time, not sure what to do next with regards my N-Power electricity account I owe nearly £1000 to them and have not been able to pay back anything for a long time as I struggled with all my debts and they insisted on me making a payment weekly which was half my income every week!
I have got a letter this morning saying they are going to come to my flat (rented from private landlord) on Friday 6th June to cut me off!
I am hoping to go to court on Thursday 5th june to declare bankrupt and I have told them this but the guy I spoke to basically said "tough they will still come out on friday" and then he gave me a phone number to ring on Monday which is their bankruptcy team.
Can someone please advise me of what to do next?
Also I need some advice on filling in my forms mainly about expenditure I have also just read that if I have been ignoring (not paying) my debts for the last 2 months ( i am on benefits, I work part time only as I am unable to work full time as I have an arthritic illness)that they may say no to my banktrupcy!
The only reason I have not been paying is because I have been trying to save up enough money to actually declare myself banktrupt!
And I have just changed job as my previous employment was selling up and the new owner did not want to keep any of the staff.
And so I am now actually working for a month with no pay as it is a month in hand.
I am so worried and feel so ill as I always go down pretty bad with my illness if stressed.

Sorry you are having such a tough time.
I can't believe that they are actually going to cut you off - I would speak to their bankruptcy team on Monday and have a good talk to them about your situation.
No-one wants to be in a position of debt and you are now taking positive steps to sorting your problem out.
Sometimes creditors make such impossible repayment demands from you that they push you into BR - I wish they could be realistic and see what they are doing!
I hope your call on Monday goes Ok - please let us know.

Another expert will be along soon and be able to offer you more advice.

Thanks for your advice.
I am in a situation that to be honest I really do not know what to do for the best :-(
I am going to go to court on Thursday 5th june for my bankruptcy, and I am just wondering if it will make a difference if they do turn up the following day.
Also I have got a persecution problem at the moment!
If I ring the bankruptcy dept of N-Power tomorrow what if they bring the cut off date forward when they know I will be declaring myself(hopefully) a bankrupt?
Also what do I do when I have been declared bankrupt if they or anyone else turns up at my door?

Hi Applebabe,

If you declare yourself Bankrupt then the debt will be written off.

As Vicki has mentioned I would ring the Bankruptcy team at N power on Monday and explain your situation.

They may however want to put you on a pre pay meter for you future bills, but have a chat with them and see what they say.

Hey applebabe, I just noticed in your post about your job. I am a restaurant owner and I am trying to sell my business. I have been told that if I sell my business as a going concern then the staff get "sold" too. If the new owner doesn't want to keep the staff then they HAVE to pay redundancy.

Obviously I don't know your circumstances and how long you've been there, but it could be something to look into. It may be that you are entitled to some sort of payout.

I was told this by the owner but as I had only been there a short time I wouldnt be entitled to any anyway
So as soon as I knew I looked for another job mainly for my own stability really.

Also Julian can you please tell me if it is true that as I havent paid any of my debts for at least 2 months the judge may deny my bankruptcy?
This is what my friend said, she said as I have not been paying them he or she may deny my bankruptcy?
The only reason I have not paid is 2 fold, because I have started a new job and am gonna get paid for a month and I have been saving the amount i need to pay for my bankruptcy!

Awww thanks anyway ANY help and advice is worth it to me at this point.
I am so worried I have to go to court alone and I am terrified!

Hi Maxine can your friend not go with you to court? If its any help it's over with very quickly. I went Bankrupt on 21st May and hadn't paid my debts for about 4 months before that.

The only way is up

You will be fine Maxine!
It is a bit scary but over in minutes.
I think it does you well to come across that way rather than to go in and look as though you don't care.
My judge seemed accepting of my situation and I know he could see I was distressed about it!
Once the court day is over you can start to plan the rest of your life.

It is so much appreciated, I hope I will stay as calm as possible, and everyone has said " you wont be the only one!"

Hi Maxine,

Don't worry. The judge's main concern is that you have sought advice which you clearly have. In your case, BR is certainly the way forward and the judge will only deny a BR if he/she doesn't believe it to be in your best interest. Looking at your situation, BR clearly is in your best interest.
