Hello, Have not filed for BR yet but probably will. i owe my mother £2000.oo what would happen if i paid her before going BR? what would the OR response be? i am also due some back money from work in August probably after i have declareed BR can i keep this, or does the OR get this or can i keep a % of it. many thakns |

Hey toon army, I would be very careful about paying back you Mum at this stage as from what I can gather, this is seen as preferential treatment and the OR could approach your mother to get the funds back. I'm not an expert so please wait for one to reply. Viki X |

Hi toon army - yes I have also read that preferential payments to family members are likely to be taken back by the OR. Family members need listing as creditors with the others on your form. I need a BR expert to confirm how your back pay will be dealt with by the OR - I have a feeling that if its wages owed then that may be OK - hang on for an expert to verify this.

The other are right if you were to pay your mother prior to the Bankruptcy then this will be seen as preferential treatment and the OR will contact your mother to request the funds.
You mention you are due some money back from work what do you mean by back?
In other words what was this for and how much is it likely to be?

It's a difficult one to call. I would suggest you inform the OR who will probably look at taking it all. The other choice is to keep quiet, but if the OR finds out, you could be looking at a BRO.

Hi Toon Army, At this time did you already pay your mother. Did your mother knows about it. Who tells her is it you or the OR. I think he must know it from you, because she get mad on to you if she hear it from other.
