Hello,

Well were do i start I recieved a letter yesterday telling me i have to attend court on Wednesday in relation to my behaviour while i was bankrupt in 2007 to answer criminal charges.

While I was bankrupt my ex partner claims she gave me a loan of £4,000 and also claims that I did not tell her I was bankrupt. This is completely untrue but obviously a very worrying situation.

Obviously I have to go to court but apart from saying this is not true what else can I do. Everyone says they are not guilty I get that but really I am not. I was an idiot and had an affair im not proud of that but this is a woman scorned and she is making my life hell. She made all sorts of wild claims and accusations and its getting me really down I just dont know what to do. This is a just one incidence of this woman trying to get me back, I did treat her badly by having the affair and leaving her but I truly did not commit any crimes what so ever. Ok morally I have done wrong but legally I really have not.

Ive been arrested and later not charged with supposedly threatening behaviour, ive had this woman turning up at my new home with meals in pots (i thought she was trying to poison me), ive had washing stolen of line, my friends and family have been contacted by her and she told lies about me, she as constantly attacked my character and as a result ive lost business because of her, she sent people around to try and intimidate me and there is more. The top of the iceberg though im now in court facing criminal charges that have been made up.

OK deep breath, they obviosly have to prove it first.

Have they set out the specific detils of what is alleged, if not then you need to ask them to do so, so that you can defend your position, you need to get as much evidence of her unreasonable behaviour to back up your position.

Who is the letter from, is it from the insolvency service, have you spoken to them about this matter before

So were you br when you were with your ex partner or was it before? And did she ever give you any money whatsoever?

The letter is from a firm of solicitors that are representing the department for business. It is a criminal case and is scheduled for court on Wednesday the first i heard about this was yesterday.

Hi RHB no she 100% did not we met after I was made bankrupt

Hi sorry just re read your post yes they have set out specific points and details which came with the letter stating that i commited a criminal offence there are in total 12 points all relating to this woman and/or the regulations i have supposedly breached

ok, you need to talk to a solicitor quickly then and get onto the department of business to provide all the information they have to you so that you can defend yourself properly

The evidence that they have is this woman basically from what i have in my possession that is all i can see. I never did it so im not expecting them to have anything else. I will 100% speak to a solicitor first thing Monday morning. Its just been a nightmare with this woman, driving me mad thanks for your help

I agree that you need to take urgent legal advice about this.

I have not to be honest i was embarrassed and felt weird and soft for reporting her. She has even gone to my mothers place of work and harrassed her stating she was carrying my child which was another lie. Im daft and wish now that i had reported her. Just fet funny ringing police saying there is a woman keep turning up at my house with cooked meals in pots and that, i guess its a guy thing but was stupid of me i know that now. Should have reported her

I wasn't trying to make you feel bad and I can understand where you are coming from. I know someone who was in a similar situation (not the BR side) and he was convinced that no one would believe him.

As well as taking legal advice it might be worth speaking to one of the experts who post on here (details in the experts section at the side of the page).

TBH, if it is her word against yours then you will be fine but as the others say best get some legal advice.

A point to remember, in a criminal case it has to be proved 'beyond reasonable doubt' whereas in a civil case it is 'on the balance of probabilities'. Therefore they would have to have some evidence, either proof of a bank transaction or receipt etc to prove this. This cannot be proven on her say so alone. So if you have not borrowed anything from her then they will not be able to convict.
Good luck with the solicitor tomorrow, remember to get the 'advanced disclosure' which is the evidence that the other party have and then you will know what you are up against.

hey george - did you watch 'u be dead' last night. it was a great film based in london / poole and on true events a couple of years back. if you saw it then you'd be feeling better about your situation this morning.
