Hi, just received a rather worrying call from the council saying they are going to issue a warranty. Does this means balliffs? They have not issued a county court hearing yet so I didn't think they were allowed to do this until after a county court hearing. I explained my situation and that I will be handing in my bankruptcy papers tomorrow or monday. The debt was because I was a guarantor on a commercial premises lease on my old business. Should I be worried about a balliff turning up at my (parents) door? Very worried now! Thanks
yes they may send anyone to come and speak to you and see if an arrangment to pay, can be reached.
They have no power of entry without court hearing.
unfortauntly the operative at the other end of the phone is only interested in saying what is necessary to get you to pay them money.
most sensible debt recovery firms (yes their is one !) will realise that if you have court date within the next week it is really not worth their involvement but they will check insolvency register to make certain that you have done the deed
Sorry Richard but bailiffs can get into your house without a court order. Even if you don't let them over the door, if they can find an open window or door anywhere they can get in.
Paul - it is unlikely that they will turn up at your door before proceedings are instituted.

I negociated a payment plan some time back with the council at £50 per week but at NO point did they inform me of court proceedings.
Therefore, I presume there has not been a CCJ or court hearing as they would need to inform me first?? Ergo, there will not be a baliff turning up unannounced?
