Hi All

My wife and I were declared bankrupt last week and have our interview with the OR Wednesday

I have received a letter from Egg saying that they have been informed of our bankruptcy and " we will be seeking payment from you for the full amount that you owe us under this agreement as at the date of your bankruptcy and we will be negotiating with the OR for payment of this sum."

It is not a secured debt so can they expect me to pay? If i had any money i wouldn't have gone bankrupt in the first place? I thought bankruptcy was a way out of this situation?

Hi Andy

It sounds as if Egg is trying to scare you. This is an unsecured debt and will rank alongside all the other unsecured debts. If it was incurred prior to your bankruptcy, It should be included. The best place for that letter is the bin

Is this a default notice by any chance. All they are saying is the amount that used to be due was the monthly payment, nowyou have defaulted they can call in the whole debt so if there is a payout from the bankruptcy they will get the full amount paid

in short, nothing to worry about, just crossing the legal t's

Just keep the letter, and when the OR asks you to send various documents in, pop the letter in the envelope for them to see, do this with anything you receive over the next few weeks, as it will take that long for many companies to update their records with the bankruptcy, and as such they will be still writing out to you. Nothing for you to do, the debts are no longer 'yours' they belong to the OR - so send anything you receive in to him
