I was made bankrupt on May 8 and had my interview with the OR this week. Can I now expect an unannounced home visit to verify the accuracy of my declaration of assests?

Hi Ken M and welcome to the forum.
Don't worry, you won't get a visit. I have never known of the OR actually checking up on assets by way of a visit. Is there anything of value that you declared in your SOA?

Phew! i was worried that would happen when i first thought about going BR, not that i have anything of value but i was worried they'd see my tv's, kids nintendo wii and playstation etc and take them off us! |

Hi Cat,
To put this in perspective, say you had a TV worth £1000. By the time the OR has paid someone to collect it and take it away, paid someone else to store it, paid someone else to electrically test and certify it, and paid someone else to sell it at auction, they'd probably only end up with £50, so what's the point?

Hi Ken,
As long as you need it for work, they can't take it. The OR cannot do anything to stop you from working, and you are allowed a vehicle up to the value of £2500. Stick to your guns and you should be fine.

Hi This is my experience with my O R regarding my motorcycle.
I put on my SOA and mentioned during the phone interview that i needed my motorcycle for work as i am a courier.
3 weeks after the O R interview i got a phone call from a auction house saying they were coming to collect the motorcycle as the O R had not exempted it.
I phoned the O R the to contest his decision but was told as i am on incapacity benefit at the moment following a heart attack i do not need the vehicle for work so they will take it and i will need to buy another motorcycle when i return to work.
The book price of my motorcycle was £1800 and i had to pay the O R £1000 to buy it back form them via my sister.
Hope you get on ok with your car but as you are on incapacity benefit be ready for the worst.

Hi Motorcycleman,
Thanks for sharing that experience. Vehicles in BR can be a bit of a grey area. If you are currently working, then the argument that you need the vehicle for work generally stands. However, if you are between jobs, off sick etc, it depends on the OR (some are more reasonable than others).

Could you not still need the car for hospital/doctors appointment? If you were unable to use or didn't have access to public transport - could you use that as a reason to still need the car??

Thanks one and all for the advice. I have tried to revalue the car because Ifelt my initial valuation of £1500 may have been over the top given that the car is a 1995 model and has 215000 miles on the clock. I cant find a website which will provide me a valuation, however. Best to speak to the OR, I guess........ |
