| I left teaching on ill health grounds in 2000 with unsecured debts of around 50,000 (though now could be paid off for less). I have a teacher's pension and receive Incapacity Benefit. I sold my home and moved to Ireland in 2002 and own a house here, a property I began to renovate until further illness prevented this. My mother lives in the UK and I could use her address but would I lose my home here - I could not physically manage that as day to day living is frequently too much for me and needs help from a friend if I want to go upstairs for instance - to sell, search for, pack up and move to another property is beyong my physical ability. I have a payment plan in place, since 2005 - but never have a hope of paying it off and since sterling took a dive and costs went up, whilst I am paying it I am limiting heating, food etc - whilst I need more and more help at home for which I have to pay. I am looking for anything that might help to make life simpler as I seem to fall between the cracks of legislation in the UK and here. Any advice very welcome. Thank you in advance. |

Hi,
You can only petition for BR in the UK if you are resident in the UK or have been living in a non-EU country for less than 3 years. As you have been living in Ireland for 8 years you would need to declare BR in Ireland.
The only way you could possibly declare BR in the UK is to return here for 6 months however the UK BR covers debts/assets in all countries so your property in Ireland would more than likely be lost.
The BR laws in the UK are more lenient than in other EU countries so there have been a spate of people moving to the UK and then declaring BR here so the OR looks very, very closely so there may be problems in proving your residency.
I would say that your best option is to speak to Paul from RevivaUK as he has experience of people living abroad and declaring BR in the UK. His contact details are available via the 'Experts' link on the left-hand side of the page. |

Welcome to the forum.
Is there any equity in your home?
I know that you don't want to go through a house move, but if you are struggling to get up the stairs, it may be the best thing for you if it's going to give you a better quality of life.
