I have already been physically threatened by 2 people that I owe money to. once I declare myself bankrupt will I have to face these people in court at any time and will they at any time have access to details such as my personal address? |

Hi Ryan,
What a terrible thing to happen. You should mention to the judge and the OR that your safety is at risk as your address will be public. If they do anything to you, report them to the police also.

As Viki says you will need to mention this to the court. It's possible to apply to the court for your details to be kept off the public register, but you need to do this at the time of your BR.

I would certainly inform the police as well. They should be able to do something if you are being threatened.

yep as kallis says inform the police, then if you get a crime number this will help with the judfes decision to withold your address |

I am aware that their are protocols for debt collection and baliffs agencies to work too, yes they going to phone you, write letters and generally be rude,bottom line is they are owed money. however to be fair most of the bigger companies adhere to the guideline ( i do not have the link to hand for the protocol).
nowhere in the guidelines does it give permission or consent for physical or threats of physical violence, this should be reported to the police
I am also aware that Trading standards and direct.gov were targetting back street loan companies and bad practises including enforcement measures. (again sorry i do not have a link but it was a news item at the beginning of January).

Depends on whether or not they are legal as to whether they follow a protocol or not.
I have not heard of any legal debt collectors making any threats towards debtors. They usually go away quite happy when they are told that you are taking steps to address the situation.

Good afternoon,
You need to contact the local Trading Standards department. They will have a specific team that deals with bogus lenders who fly in the face of the law. Do it tomorrow!
You may also contact the local police who will also have a team to assist you with a crackdown on bogus lenders (in conjunction with the TSD)
You should also tell the OR

In my experience it is usually former friends or trade creditors that exhibit this sort of behaviour, not legal debt collectors |
