Ok i have asked so many different people about this and can not get a difinitive answer.

I have mortgage with ex partner. A Together Mortgage through northern rock. I have £123,000 mortgage (interest only) and £23000 unsecured joint to the property. These are both in mine and my exs names.

I have £16000 of unsecured debt now. I am filing for bankruptcy within next two months.

I want to put house and unsecured debt into the bancruptcy. ( i know the unsecured gets put in and they chase my ex for money )

The mortgage payments are being paid in full by ex as she likes to mess me around and sometimes pay and sometimes not.. but for last 6 motnhs she has made all payments on time and Northern Rock are happy .. but know she will not pay in few months just to wind me up.

The house is in negative equity of -£10000
I need to know a couple of things if anyone can help.

1. Can i get my mortgage put into the bankruptcy so that i have nothing to do with it.

2. If i go bankrupt and i get dishcharded and want to build my credit rating up only for my ex to decide not to pay mortgage in 2 years will this effect me?

3. Can i ask for settlement of any kind from northern rock.. even the full amount and put that in the bankruptcy?

Basically this girl wants me tied to her forever and i dont want this i want to sell house but she wont sign. I
If anyone can help me get out of this through the bankrupt way let me know.

Ive been told by solicitor that when i go bankrupt i have nothing to do with house.. but northern rock said that wont be case.

Thanks in advance.

Hi Memphis

Difficult situation (great question), this needs direct contact with an expert as each time i say yes to part of your question i also have a what if question >

i can answer Q3
3) NO chance

i initially typed war and peace in response but that would only be my interprettation and a response in your favour but the wording would not be PC and probably sensored on here !

I would have a word with an expert, you can find details of several of them under the expert link on the lefthand side of the page.

Buckle your seat belt Dorothy, 'cos Kansas is going bye bye.
