I have had a letter for bank ruptcy for £1,635.oo i have offered a monthly payment of £100 but they will not accept this they are demanding £817 up front but do not have this please can you advise what I can do.

Hi and welcome,

Is this a definite bankruptcy or just a threat of it if you don't pay? It is most unusual for a creditor to make you bankrupt, especially for such a small sum.

Stick to your guns and continue with a low offer of payment.

Hi Jill

Kallis is correct however certain creditors will persue debts through courts (HMRC main one).

Do you have other debts ?

are you able to deal with these debts ?

is it the original debt holder that is chasing you or an agent ?

The wordings on lots of these debts letters although not supposed to look like real court documents are created to make you think and grab your attention.

Take the letter to CAB or a solicitor get them to read it or speak to one of the experts and ask if they would not mind if you scanned the letter to them for guidance

I am ok with other debts, the letter is from a company called Hampton Legal when I call them they answer it by the name of Lowells, they will not accept anything than a lump sum down but I have offered a monthly figure, I have been advised to go to our local court and explain to them and get them to sort out a payment plan, with out the bankrupcy happening, I am so worried.
It is not a court letter, but says I have 21 days to sort it out.

Yes this is Lowell Portfolio 1 Ltd who have Hamptons as their in house solicitor, they are one of a few creditors who buy ip other debts and will folow through with the bankruptcy especially if you have a property that you own. They are usualy for small amounts and they make most of their money from charging solicitors fees before and during the bankruptcy

What is your advise ??? I really do not have tne amount they have asked for, but can cover monthly repayments.

I cant really advise, but, if it was me i would pay as much as possible to them whether they agree or not, try and get the debt down as much as possible before the court hearing, to show the judge you can pay in a reasonable time, That still may not stop the bankruptcy but it gives you a chance

Hi Jill

LP will mess you around say payments not made and still go to court.

this sounds like a BR threat not an actual court date. I dont have the paperwork in front of me to read actual words and inference.

did you manage to get response from solicitor, CAB or other forum expert after they have viewed document

do not take out further credit to pay this debt.

Make a reasonable affordable offer in writing for a monthly sum with a cheque for first months money.
