 Hi, i went bankrupt in November 2011

Hi,
i went bankrupt in November 2011 and have since been discharged, however i have to continue making monthly payments until January next year. I was appointed a trustee to take charge of things. As yet, no moves have been made on my house, there was some equity, about 16 thousand i would think, of which half belongs to my estranged husband. Do you think it is likely that they will at this stage still sell the house? Also, i would like to get divorced so that i can re-marry and have been hanging on as i feel my life is on hold at the moment. Should i receive any settlement from a divorce would i be able to keep the money or would my trustee take that from me even though i am discharged? Also, would it be simpler to wait to re-marry until i have finished making monthly payments to my trustee?

Hi Karon

Bankrupt and discharged in the future (nov 2011) gosh you are organised

trustees will be looking after your estate and the equity would belong to them.

marriage / divorce not an expert on that bit still on number one !

Can you confirm the dates that you were made BR and discharged as the trustee has 3 years to deal with the sale of the house.

If you are discharged from BR as far as I know it's yours to keep, but hopefully one of the experts will confirm.

Don't put your life on hold - if you want to get married then go for it!

Thanks for your replies, sorry i had a bit of a mad moment when i put November 2011! I went bankrupt in November 2008 ad was discharged November 2009, therfore my three years will be up in November 2011 but i have to pay monthly payments until January 2012. I thought that normally the house was sold after a year and thats why i wondered if it is still likely to happen.
