Dear All & Experts,
Can anyone shed light on the confidentiality of this forum. Does anyone think ORs will be looking regularly on this forum to look for evidence?
Sorry to be so paranoid..but this forum is a really good in giving and assurances to current bankrupts and I would like to think all posters should be encouraged to be as open and forthcoming as possible for the benefit for all other members? Any comments? |

I imagine that they probably do, Examiners regularly use any information they can glean from the internet, Your facebook page for example, i know of cases where people have left pictures of themselves next to brand new cars ready for a DVLA check
Or people sometimes pop up in news stories that give certain information away about them
Hence not a good idea to use your real name, apart from that there are thousands of bankruptcies so unless your case is extra special, it is unlikely to be connected |

Thanks for that. Do us bankrupts have to be worried that ORs get acces to our personal email accounts?
Also I have another question, when does an OR consider cash transfers to family as taking preference over creditors as "stale", I made payment to my brother 3 years before my bankruptcy, when he needed some help, I already had some credit card then but did not take out any loans which make up half of my bankruptcy debts.

They dont get automatic access to you e-mail accounts.
Preference payments are stale after 2 years to family members

If I was an examiner I would read the postings. not to catch people out but to keep updated of the different interpretations of the guidance being experienced across the country.
If I was a manager i would use it to get feedback on how my team were performing
if you are concerned about personal and sensitive issues I would contact one of the experts directly.
Use the forum for general what ifs and general questions. I do commend some of the recent topic threads and the personal challenges faced by some. I and others will do our best to help in an open supportive forum
as a last point i would say if you do not want your full name known use a user name and remove your full name from avita Mr JA & Mr JB

Hi, Like anything else, this is an open forum and anyone can access it, but I wasn't aware of anyone at my office accessing it.
As for access to emails, etc. the OR doesn't have access to them(if they did, they would have to make a RIPA(regulation of investigatory powers act)application, which is generally for terrorism and organised crime, and until recently some councils.
For investigation purposes, anything over 3 years is regarded as stale.
