My daughter wishes to declare herself bankrupt, she is very ill, receiving Incapacity benefit and with no medium term prospect of this changing and debtors who despite considerable effort will not be reasonable about monthly payments. My question is, if she uses my address as a correspondence address will this impact on me as I have the same sirname?
Hi flier - welcome to the forum Sorry to hear your daughter is having a tough time.
You can contact each credit reference agency and complete a notice of disassociation - this disassociates you from any of your daughters credit and her BR. This should protect your own credit rating.
When you say credit ref agency do you mean Eqifax & Experian? Just that when i declare BR i'm gonna have to get my other half to write off and disassociate themselves from me.
That has given me something to think about. She could use her grannys address where there is a different name, this might be better as granny does not use credit either. But as this is in another county I am assuming she would have to go to the court in that area?
No I don't think it matters. I did the disassociation and I went BR. Nothing to stop you doing it the other way round.
Flier - the fact that the name is different doesn't make any difference - its any association with finance at the address. When your daughter goes BR they look back at addresses held previously and include them in the notice of BR so it might not make any difference if you use another address as your address would be mentioned anyway.
Once again many thanks for the advice. I will start the process of bankruptcy today. I would normally make payments to 4 of her creditors about now under arrangements agreed with them, should I make the payments to avoid extra charges? or is this irrelevant? should I write to them to let them know of her bankruptcy application or wait until I have a date for her going bankrupt. Like many on the forum I am worn out with it all so I dont want to do more than I have to, but want to do what is best to avoid further problems.
If you are going BR fairly shortly, then I would suggest ceasing there payments and saving your money. The creditors will (in all liklihood) keep hounding you until after you've gone BR. You're almost there!
