hi all ive just declared bankruptcy on the 24th march and have my or call this thursday .
quick question as i have declared bankruptcy and my husmand is yet to do it in the next couple of weeks we have recievedd our new council tax bill for this year am i accountable for the bill or would my husband be able to put it down under his bankruptcy the bill is in joint names if i have to pay it i will but i want to check first x

As far as I am aware the bill can be included in your husband's BR although you would then become liable for the full amount.

Last IPA payment made on 28th June 2010 - it's over at last!

so if my husband includes this in his bankruptcy i will still have to pay full amount or part off sorry for asking daft questions but i want to be clear on things we dont have to pay for i understand that i am liable for paying for things again once bankrupt but if my husband can declare this as part of his and the payment is halfed that would help .
i know its going to be a slow process getting back on our feet but if we can save money by not paying full council tax bill then the money can help towards paying his .
knowing my luck i have to pay the bloomin lot x

Hopefully someone with more knowledge about council tax than me will confirm, but the way I understand it is that if something is in joint names you are jointly and severably liable, meaning if one party goes BR the other is liable for the full amount.

yes i think you are right tracey so theres probably no point in him putting it as part of his br .
some of our debts are in joint names so it will be the same as i have done my br first the debt automatically moves to him but unfortunatly this was the only way we could do it .
if i have to pay i will do at least then when he goes for his we are clear and everything is above board .
im just in the process of writing post its and sticking them to my br papers for thursday when i have my or telephone call i know i will be ok if im organised im also keeping all the notes ive got for when i fill in my husbands my goodness be glad when its all over

your Br or your husband's petition won;t cover the new bill for year commencing April 2011 - March 2012.

yes as reveiva says.

for info, council tax accrues on a daily basis even though they let you know about the whole years bill at the start, this means that the rest of the year is not yet due and so cannot be included, there are some circumstances (for instance a liability order) where the whole year does become due immeadiatly and so could be included, but this does not seem to be what is happening here

also bear in mind that unpaid council tax is pursued in a different way to other unsecured debts.

They don't follow the CCJ route. Instead the council has a "fast track" procedure which means that they can go straight to court - Magistrates rather than County Court - and they almost always go straight to bailiffs unless an agreement is made.

my husband is being harrasssed for council tax .
i will just pay the bill when it is due imsick of all the worry x

Hi,
as others have said here patty, council tax accrues on a daily basis,so the arrears accrue on a daily/monthly basis unless paid. As you are bankrupt already any laibilities would have passed to your husband, but of course you are liable for the new council tax as it is post bankruptcy.

So from your last posting I'm assuming that you already have arrears on previous years council tax, which is why your husband is being pursued as he's not yet bankrupt, so why pay the arrears if he's going to declare himself bankrupt as well? what you have to pay is the CT bill for 2011/12.

You'll have to speak to the council but I don't see any reason why you can't.

You need to get it sorted though as the new payments start this month.

hi big al and thanks for your offer but we are too far away also our son had a abd accident and had to have his arm opperated on last week involving wires and pins so we are a little limited as to travelling at the moment .
my husband has a debt through acting as a guarantor for someone and its quite large at our previous address we recieved letters through the door from them all the time but since moving last april we have had nothing obviously my husband did not contact them to let them know we where moving but im suprised they havent been able to trace his new address he would like to be taken for bankruptcy by one of the companys he owes money to would it be wise for him to contact them or wait and pay for the br when he has the funds these debts are easily 3 years old now .
