Hi, need advice please as to what is going to happen next, the house is going for repossesion by the lender as myself and ex husband are divorced and can no longer pay the mortgage, i'm a discharged bankrupt, he however is not, he hasn't adhered to the terms of the bankrupcy and is now indefiently suspended from discharge. I'm wanting to know having just recieved a letter saying possession proceddings have been commenced to my local county court what is going to happen next, and (because ex husband is working, and i claim benefits) would we both be made to pay (the house is in £40.000 of neg equity) Thanks Lea

If you had this debt prior to you being made BR your BR will cover it so you won't owe any more money.

Hi

Sorry to learn of your problems.

Please set out the situation as it is at the moment:

Is the matter subject to a suspended possession order?
What is the present position with your lender?
How much are the arrears?
Is there a second charge?
Have you got children/dependents?
Have you spoken to any adviser?
Have you spoken to the council?

Housing.....No Idea over the suspended possession, having just got this one letter saying about it being commenced to county court...Arrears...£5.0000 Second charge...Yes Of £30.0000... This was put down on the forms for our bankrupcy, but we bought back the beneficial interest off the official receiver..One child, And I Have a home through the council ready for myself and child to move into....I'm just wanting to know what is going to happen nxt, will they send a date in which we have to attend court? Will i have anything to pay on the shortfall from the secured loan and mortgage? Thanks Lea
