 Hi, I have a question about Council tax.

Hi,

I have a question about Council tax.

My husband and I went BR in September 2010 and handed back the keys to house the mortgage company at the time. We now live in rented accommodation and have had no contact from the mortgage company or OR about the house so we don't know if it has been sold or not.

When we relocated we spoke to the Council regarding the council tax and they put an exemption on it for the remaining tax year, meaning that we were not liable to pay it as the property was vacant. We have now received a new Council Tax bill for the 2011/2012 tax year asking for our full payment for the new period. My husband spoke to the Council tax office and they are adamant that we are still liable to pay it even though we no longer own the property and have no idea if anyone else does.

I've spoken to the OR about this and he has advised that as this amount was 'incurred' after the BR date it is not included in the BR order and there is nothing they can do.

Has anyone else had this problem with Council Tax? Surely we cannot be expected to pay it on a house we have surrendered?

Please any advice?!

I'm not sure as we've not heard anything from the mortgage company, Santander. We just sent the keys back with a covering letter along with their 'official' letter they sent us (which we did not sign) but we've heard nothing since.

I did see it up for sale on the internet a few months ago but cannot find it as a 'sold' property on mouseprice or any of the other property search engines so I think they've tried to sell it but not had any interest. If they've tried to sell it then presumably they must have taken possession officially?

yes, then you need to get them to send you something saying it has been repossessed and then send that to the council, they will preume you are liable until you prove otherwise

This is the one you are after

Class L - mortgagee in possession, Valid from date of repossession until property is sold or lender gives up possession
