Hi. Im in an IVA at the moment & am struggling to make the monthly payments. Another company has contacted me & said as i have no assets then bankrupcy would have been a better route for me to take. Is that right?

Hi Lindsay,

The company that has contacted you got your details from the insolvency register.

They don't know your circumstances and are touting for business. They will tell you that you were mis-sold your IVA and that you should declare bankruptcy. They will then charge you for it.

If you are struggling with your IVA, you really need to speak to your insolvency practitioner and complete a new income and expenditure.

Bankruptcy may well be an option for you, but please don't listen to this company, take advice from your own IP.

I can only agree with Viki.
Please, please stay away from this company & speak to your IP.
Post back on the forum if you need any more advice/support.

Hi Lyndsey - totally agree with the others!

These companies have no idea of your personal circumstances and get your details from the Insolvency Register. They are just out to make money from you.

How do they know that you have no assets?

If you're struggling then speak to your IP in the first instance. If you really cannot continue then you can declare bankruptcy yourself for the court fees or use a firm who does not charge the earth if you need help.
