Hello,
I have been lurking for a while and I really could do with your support and advice as I can no longer cope with the pressure from my creditors.
My potted history is as follows...I'm 45 years old and have got myself into £27,000 of debt.The debt is with a fair few companies and up until october 2010 I never defaulted on any payments. My partner left me in october and the debts were in my name. On 4th of Jan I was made redundant from my job( no redundancy as not been employed long enough)I sought advice from citizens advice bureau and have been making token payments of £2-£5 a month with all of my creditors.
They just dont stop calling me. Halifax has my bank account and this is up to the hilt on a £2050 overdraft, all my benefits for my rent etc are paid into this account.I have a loan and a credit card also with Halifax and they are now telling me that they will draw from my current account to cover the loan and credit card.
If they do this I will lose my home. Should I try and set up a cash minder account now? I am not likely to have bankruptcy fees until nov at the earliest (with a will and a prayer!!)

Sorry you are in such a mess, life has not been kind to you recently has it?

I would open a cashminder account now and transfer everything across to it as Halifix will offset from your current account.

Do you have any equity in your home?

Hi Darkday & welcome to the forum.
So sorry to hear how things are going for you at the moment. It is an awful time & one that we have all been through and we do understand how you are feeling & will try and help as much as possible with advice from the experts here and also support where we can.
As jan has said, get that co-op cashminder account opened and start organising your finances through it,ie DD's/SO's etc. You will have enough to think about nearer your BR time without worrying about having your bank account closed.
Try & answer any questions that the experts need answering as they will be able to get a greater picture of your circumstances and therefore offer the best advice.
Do keep posting with any questions no matter how trivial you think they are.

Thank you very much for replying. I burst into tears when I read your replies as it is such a relief to get things off my chest!
I had a job interview today and Im keeping everything crossed that I may be successful. But the downside is that it is nowhere near the income I had BUT it does get me off job seekers allowance.
I do not own my home and I have rented it since April 2004 with a private landlord.
My rent is £730 PCM and even if I get the job I will still be reliant on housing benefit to some extent. I have a son who is 16 and in full time education.
If I try and open a cashminder account now, will it be taken away if I go bankrupt?
I cant believe I have got myself into such a mess,I feel so unworthy and like a criminal especially when I walk into my Halifax bank to pay my pitiful gesture towards my loan and credit card.

A cashminder account will be ok with bankruptcy.

You are not a criminal at all, we've all been in deep debt and done our best to get out of it.

I will call co-op in the morning and try and set up a cash minder account. At least this will save me the £30 a month overdraft fees Im paying at the moment.
What should I do with the creditors that are taking money off my visa debit card with my Halifax account? This will increase my debt and cause me bounced charges?
Should I transfer the standing orders that I have with my creditors as well as the usual stuff?

If you are going to go bankrupt then don't worry - these charges will be included in the BR. Just make sure any debits go to the new account and that DD's such as council tax, mortgage and utilities are moved across to the new account. Don't move your creditors across.

Wow! I have calls all day and evening now, surely this will make my creditors worse
I dont see I have any other option than to go bankrupt. But I still need to find the fee's to do this.
Will I be able to hang on until at least november without bailiffs?
If I get this job my creditors will want an ever bigger slice than I am already trying to scape up. Should I just not tell them if I get the job? Sorry for so many questions... I'm in 'full panic mode'

I think you will be ok but of course I'm no expert! Have a word with one of the experts who post on here, their details can be found on the left hand side of the page. One of them should be able to put your mind at rest.

Morning darkday
Try not to panic.....
I know it seems like things are getting on top but this is the worst bit as there is so much to learn & take in.
Very sound advice off Jan & don't worry about too many questions, there are never TOO MANY!

I cannot offer 'expert' advice but will try and do what I can with general stuff/support etc as will others on this forum.It does get better, honest, & as long as you are aware of the short & long term effects of BR you will do ok.

As Jan has said, the cashminder acc' is fine with BR & does not get closed by the OR's. We just informed the OR during our telephone interview of the reason for this acc' & all was fine.

As for paying your BR fees, Have you tried applying to the utility companies, water, electric etc for assistance with these? They have welfare departments that can help toward BR. Just have nosey online under 'help with Bankruptcy fees' I Googled it. Also we had a refund off United Utilities post BR of the amount we owed them!

I can't add anything to the advice that Jan and Glafy have given you but I wanted to say we are all here for you so please keep posting.

Regarding all the phone calls, have you thought about changing your phone number?

Hello Again!
Well I phoned co-op and went through a few questions and when the nice man said I had to wait a bit whilst they did a credit search I felt like I was going to pass out.... anyway he said YES- I had been accepted Phew, and my welcome pack and visa debit card will arrive in the next 3-5 days!!
Just need to get the job now and that will be the second positive thing that has happened for me in at least 9 months

Well Ladies and Gents,
I did a 10 hour shift today as a trial for the job I was chasing, and I have got it!!!!!!
Being unemployed for 6 months has dented my confidence considerably so you most likely wont understand the fact I am almost cartwheeling around my sitting room
I know you have answered lots of questions about people keeping their cars if they go Bankrupt and I am hoping that I will be able to keep mine??
Its a 2002 dented but very reliable Suzuki Wagon R. My journey to work to work and back will be a 25 mile round trip. The nearest train station is a 45 minute walk (for a svelte, Julia Roberts type person) I am more Jo Brand/Dawn French shape so I'm guessing about twice that time?
Do you think they will let me keep my car?
