I am going to petition for my bankruptcy, but I was in need of some information pleae. I was in an IVA but could not keep up with payments, and as a result it was terminated. You do I go bakrupt myself? If I print out the papers from the insolvency website, can I simply take them down to the courts and be heard?
Also during my IVA I have taken out payday loans which I was not supposed to. But due to my struggles I foolishly did. Could I be breaking the law for doing so?

Hi Shaun,

You need to make sure you have your failure certificate from your IVA company, download the BR forms, fill them in and then call your local county court and make an appointment first, don't forget your fee of £700 in cash.

Depending on how much the payday loans are for, I doubt you will get in too much trouble, I presume you needed this money to live on. You haven't broken the law so please don't worry.

I suggest you call an expert and have a chat, or speak to your IVA company who may provide assistance.
