I have just hopped over from the IVA forum, I have been looking in to an IVA with Melanies team but it looks like the best and only option is BR. I wonder if anyone can answer a few questions for me.
My hubby was attacked back in Feb and has applied for criminal injuries as he sustained facial injuries, we havn,t heard how it's going, I was just wondering if he is allowed the claim would it affect the BR, or would the OR take the money off us, we have been advised it won't be alot just enough for him to get his teeth replaced etc.
As my husband works away and the waiting list for CAB is a while I can't get an appointment till 4th July we will be struggling to pay the bills next month, I spoke to Barclay Card today to offer a token, they wouldn't take a token payment I was told I have to speak to another dept on Tuesday (I don't know why Tuesday) My next hurdle is HSBC our account is with them we also have cc's,loan and the mortgage, we can afford to pay the mortgage does anyone know if I could change the DD for the mortgage to another bank. I have just opened a co-op cashminder account should I start to change things over straight away?

Hi there ann and welcome to this forum. Sorry the IVA option wasn't suitable for you on this occasion, but bankruptcy proceedings are not that bad when you dig into things a little more.
Why not have a chat with Paul Johns of Reviva who is a regular poster on this forum. Paul gives free and impartial advice as to the bankruptcy process, and you would be able to talk to him much quicker than the CAB.

Thanks for the reply Melanie, I have sat all day going through the forum, it is interesting what you can learn, especially what other people are going through, at first I felt alone till I found the IVA/BR forums. I have another question does anyone know if my hubby would keep his car if it is on a motor loan not HP, as he needs it to go back and forth to Aberdeen(5hrs drive) not sure how many miles? We are also in neg equity with our house would the OR allow us to keep it as have not defaultd on the payments and we can afford the mortgage. |

The loan will be lost in the bankruptcy, so long as it is unsecured and not a HP agreement, so your husband will not be allowed to keep a car of such high value. The OR will usually allow £2,000 - but you might be able to negotiate a little more on the basis of his long journeys.

The reason we got this car was the fuel consumption also he gives his work collegues alift, the car we had before was doing 18 mile per gallon now the one we have now does 35-40 which saves us money, especially with the price of fuel. A flight to aberdeen cost 169.oo single 310 return and thats internal. the train is alot cheeper but as he works offshore he sometimes gets the call to go at 4pm the last direct train to aberdeen is 5pm it takes about 45mins on the metro to get to the station, if he misses his check in for the rigg he looses his wage, that is why he relies on the car. |

The OR will not necessarily see that this warrants such an expensive car, Ann. A far more economic choice could be made which would still give great mileage to the gallon.

The CAB are a good source of advice but in many areas the wait is prohibitive and your stress point seems now.
We often have discussions with clients until 11pm purely because it is the only time available.
If you decide to call I would be delighted to provide free and impartial advice.

hi,
Is your husband going BR also? is the finance for the car in his name?
I thought that if he was not declaring BR and the finance was in his name then the OR couldn't ask for the car to be sold?

Yes we are both going BR hopefully we have gettin ourselves in such a mess and this seems the only way out, we are hoping we will not have to sell the house as it is neg equity. At the minute with my husband away and not back till Thursday I'm trying to keep myself together for the sake of our son. |

Hi Eamonn & Vicki, thanks for the support, I feel so ashamed we have been digging our heads in the sand for so long, Question for Vicki did you fill in your own forms or did you get help? as yet we havn't got the money to go BR so I now need to stop paying the creditors and then await the phone calls, I hope i don't get any at work as this may cause a few problems.

Hi ann - sorry to take a while to get back to you. I completed the forms on my own with support directly from Brett England (BR assist expert on this forum) and by asking lots of questions on this forum. Paul of Reviva provides the same support to forum members. Please don't be ashamed. I struggled with debts for what must have been more than five years - taking out debt consolidation loans - then using my credit cards again. I then had a failed IVA before going BR in April. You haven't done anything that any other person going BR hasn't done already! Creditors won't ring you at work before trying to ring you at home. If they do tell them to ring you at home at a time that suits you. Don't be hassled by them. When are you thinking of going BR?
