hi aerlier i asked about going fron an iva to bankruptcy. i did not make it clear that due to non payment over the last 6months to the iva we have failed, that is why i want to go the next step and put in for bankruptcy. but as i said my husband is worried about this step. what happens if he will not take bankruptcy? what steps will the banks take? as we are 60 and 62yrs i want to get this cleared asap and start afresh. we have lived in south africa for 30yrs and had to leave everything behind and have deen back 5yrs but not made a very good start to what was meant to be a good retirement.

As your IVA has failed you are now back in the same position as before, you and your partner need to understand bankruptcy and the consequences of such a move, why not try your local CAB office get an appointment and ask questions, your husband needs to understand such a move prior to rejecting it
