I was declared bankrupt in Jan 2009 as a result of my ex husband building up debts in my name. Luckily i was discharged only 6 months after. My ex husband bought out the BI at the time as we still owned a house together in joint names. It's almost three years since i was declared bankrupt, and my name is still on the house we shared together (that he now rents out) In our divorce settlement it as agreed that i should retain the home, my question is, is there any way i can now make a cliam on the property? |

depends on the wording of D settlement, court agreed or solicitor agreed.
by reading what you have typed you have the mortgage and house, he has the equity. unless wording of D assigned you the beneficial interest, might be worth going back to original solicitor

Thanks for your help!!
The Divorce was ordered by the court and it stated that in the event of the house being sold, i would receive the first 10K and any equity there afrer we should spilt 50/50.
He bought the BI from the court back in 2009, but the mortgage has remained in joint names ever since. He now rents the property out, and i don't receive any money etc from the house, but then neither am i responsible for any repairs.....
I just wondered if anyone knew if my divorce settlement still had any relevence as my ex husband had bought the BI??
