 I&E - filing on 14th, is this reasonable?

Hi
Please could you take a look at my expenditure list?

I haven't included any payments to loans or credit cards that my hubby makes.

members of household = 2
my income = £0
Spouse income £1300 average


Rent £365
Council tax £131
Housekeeping £200
Travelling £130
Clothing £60
Heat & Light £78
Water £46
Phone £60
Spouse Life insurance £20
Vehicle tax £20
Vehicle Insurance £42
Vehicle maintenance & MOT £25
TV license £12
Pet food (3 cats)&vet £70
Dentist £20
Prescriptions £10
Hairdressing £20
Dry cleaning £10
UK holiday £10
Emergencies £20

Total £1349

the SOA will show he contributes 100% of household bills. Going by the list above it obviously shows a deficit but some of these figures are annual averages divided by 12. Is it ok to do this? will the OR see that as ok?

any help/feedback welcome

Hi there,

As far as I can see, your I&E looks reasonable. The only thing they might not agree to is your spouse's life insurance, holidays and pet food, etc. It depends on the OR assigned to you. Although there are general guidelines, from my experience, what is allowed by one OR, can be disallowed by another. From my personal experience I was allowed £250 housekeeping as a single man and was allowed Holidays of £20 but not allowed Dental costs. I think they tend to even it out, so if you are claiming absolutely everything, then the chances are they will allow some, but not others. As I said, it is not written in stone and I would send this off and see what comes back from the OR's office. If you then have a disagreement you can go back to the OR and try and sort it out, although there is no guarantee they will accept it even then, but it's worth a try. By the way, is it only you going bankrupt or your spouse, or both?

thanks for the feedback

its just me going bankrupt so i suppose that what i put down is academic really but i just want to get things right.
its my understanding that as i have no income the OR cannot make an order for me to pay anything. the only household income we have is my husbands earnings and he can't order him to pay as its my debt. am i right??????

Hi,

As it is only yourself going bankrupt, then I would have thought that your husband is only expected to contribute to the household costs (food, bills, etc). As you are not earning I cannot imagine you will get an IPA as you have no disposable income personally, Regardless of whether your husband has any. As I not really had much experience in bankruptcy while living as a married couple I could be totally wrong, but I think it is the person who is actually going bankrupt who is involved rather than their partners when it comes to any payment issues. Even if you were earning, it would only be your income they would take into account (apart from your husbands contributions as I have already stated). You are the one going bankrupt not your husband. Maybe if I am wrong on this, an expert can correct me?
