Hi, me again,

You've all helped me so much before but here we go, yet another question:

I was self declared BR on 3rd March 2011. Since then I've had the OR interview (face to face) and been referred to a trustee.

At the moment I work part time earning a very small wage. Not enough to warrant my trustee even bothering about as it doesn't really cover my cost of living (my partner helps out with that, I do pay my way though with rent, household bills etc, but he certainly now has the burden.

Before BR I was earning £36k/year, then I was redundant, then had several short term jobs, survived on credit cards, then realised I could not cope so went BR myself my choice.

Now I've been earning about £7k/year working part time and trustees aren't interested in "the odd £100 or so". But I have a job interview for a job that pays about £20k/year.

QUESTION: How do I approach this if I get offered the job? Will my trustee take any excess money earnt and will this go on for many years? What I realy want to ask is, if I hang on with my poorly paid job until 3rd March 2012 discharge date, will I be affeceted afterwards if I get a better job (and can I keep my money earned?)

This sounds confused I'm sorry. Hopefully someone can interpret what I'm talking about and reply constructively.

Hi Widge,

They only have until you are discharged to set up an income payment agreement, which will take any surplus you have for 3 years, that's if you have any surplus.

So I'm a bit scuppered in getting a 'proper' job for three years then? What's the point, as I'll be no better off financially?

I thought that once you're discharged that you're finished with them all except the mark on your credit report?

Does this therefore make it NOT worth my while to accept a better paid job?

Confused how to respond at interview and whether to go anyway so as not to waste their time and my money getting there!!!

Hmmm, personally, I'd go for the job if it's something that you want to do. Don't miss out on an opportunity if it's right for you.

Sit down and calculate your income and expenditure with the new job and see if you have any surplus. Then you can work out if you will need to pay anything back.

A very complex exercise actually. I currently appreciate the freedom that part time work brings. And because I work in Waitrose 'til closing three nights a week I have the privilege of getting many food bargains at close of play before wastage. For example, last night I bought £5.93 of fresh salmon fillets for 10 pence. A bag of potatoes for 10p, Some fresh green beans, asparagus and a cabbage, and two tubs of fresh beef stock for 10p each too...oooh and some plums and a pineapple...all for 10p each.

SO basically, I'm trying to ask something that is 'sort of' along the lines of...Would I be better off getting a better paid job until after I am discharged from BR???

Only you can answer that Widge. Some people Will tell you that you shouldn't turn a good job down as you may struggle to get another. And some people Will tell you to wait until after discharge so that all of your wage is yours.

I'm sure you'll make the right choice and in the meantime enjoy your bargains, sounds fab!

alround yours for fish supper followed by fruit salad.

no one can dictate what job you must do, the choice is yours, yes if you get offered a job and the long term benfits suit the needs of you and your family.Do it. alternatly now the debts have been removed and you as a family are enjoying your new found family time stick with that.

PLs do not refuse a job only on the grounds of not paying an IPA.

I have changed from employee to a self employment job since BR and during IPA with improved long term money , I have declared this to my trustee, we have reviewed my I & E and found allowances that i have not previously claimed or am now entitled to claim !.

The net result is a sect 299 of the insolvency act. release of trustee and an application for an early end to my IPA.

The job is only a temp contract until the end of March 2012. So I'd be giving up a permanent part time job for a temporary full time job.

I don't think I can risk it. Maybe I don't even go to interview and write to explain why? Unless I ask that they can pay me LESS until my discharge date?

If it is only a temporary job, what will happen after March? You may be out of work permanently.

Personally, I think I'd stick with what I had.

Mmmmm, I've done some calculations and I don't think I should go for the job, even though it's better money. The trustee money monsters will be out to steal any excess (more stress, no doubt) and all for a wait of 4-5 months until I'm discharged.

Does anyone think I should explain this to my potential employers and send my apologies?

No, I would just apologise and tell them that you have decided to stay in your current employment at the moment. That way, if something comes up in the future with them, they don't know any details.

After a great deal of thought I have decided not to attend the interview. I'v had enough stress this year what with the bankruptcy, moving hous and continuing financial battles with the ex. I don't think swapping a permanent, albeit part-time job for a temporary full time job would resolve anything. Especially if I end up with a IPA longer term and I'd probably be worse off financially than I am now!

If I post a draft letter on here would you guys be able to comment and I'll construct an apology reply to them to send to them on Monday morning?

Draft letter - short and to the point without giving too much away -

"Thank you for your kind invitation to attend interview on Tuesday 15th November at 13:00 hrs. I have given this a great deal of thought and it is with regret that I have decided that at this point in time, it best to remain in my current permanent employment. I therefore offer my sincere apologies and will not be attending the interview."
