I AM FILING FOR BANKRUPTCY IN THE NEW YEAR BUT REALLY COULD DO WITH SOME HELP TO GET ME THROUGH THE NEXT COUPLE OF WEEKS. IF I WAS TO WITHDRAW OR USE TO PURCHASE ESSENTIALS WITH ANY REMAINING CREDIT ON MY CREDIT CARDS WOULD THIS GO AGAINST ME IN ANY WAY.
Hi and welcome to the forum. You really shouldn't be using credit cards or an overdraft as you are insolvent. The OR could take a dim view of this and you could end up with a restriction order.
In the lead up to my BR I used the money I would have been paying my creditors to live off.
Only when the last tree has died, the last river has been poisoned and the last fish has been caught will we realise that we cannot eat money.
Last IPA payment made on 28th June 2010 and I'm now looking forward to getting married in September 2012 - I'm proof that you can go BR and come out the other side.
My problem is that because I am already in my overdraft and so any money I am receiving from the tax credits to live is only reducing the overdraft. what can I do?
I have opened the Co-Op account but it will take upto 10 days for the whole thing to be live. if i do access the payments from my current account will i get in trouble?
If your income and benefits are going into that account, then yes, you will have to keep using it.
Your original question was about using available credit on credit cards not your bank account. Some people don't even know to open a new account prior to bankruptcy so don't worry about using your account. But, stop using your credit cards and stop paying all debts.
Good luck with your bankruptcy, we're all here for you.
