do i have to inform my creditors that am going abroad and do i change my address to overseas address. Ve made up my mind to return home since i cant not pay back the debt.

Hi Olu,

If you are still currently in the UK, then I would sugegst going BR before you leave to make things easier all round!

Hi Olu,

In that case, it's a pure judgement call on your part. I would encourage you to be up-front with your creditors as they did, after all, lend you the money in good faith.

I think it probably would affect any visa application. Especially if you are bankrupt in your absence and then fail to co-operate with the Official Receiver, as you would end up with a suspension of discharge.
Your largest debt seem to be with your former employer, so they are the most likely to petition for your bankruptcy, if they would even bother.
I don't imagine the other creditors would bother as they would look at whether it would be commercial to do so, and if you have no assets it would not be.
Have you got a job now?
Is there no other way you can sort out these debts?

please what other option do i have
i have no job and my visa is expiry next week
do i need to overstay as i cannot renew it without a job
its quite a complex case
i just wish i could die or end my life
am too disturbed.
any suggestion

Hi Olu,

Do you intend on coming back to the UK within 6 years? If not, then ...

(a) Any BR will have come off your credit file, and
(b) the Statute of Limitations comes into play. If you make no payments on an unsecured debt for 6 years, then the debt ceases to exist.

when does the six years start counting?

can i visit only during the six years or i wont be alllowed entry?

wat if i make a promise to pay later?

The legal process in which a person declares their inability to pay debts. The proceeds of all available assets are distributed to creditors. Both types of bankruptcy stay on the borrower's credit history for up to 10 years. I think, the best thing you need to do is to take legal actions. Face whatever and whoever you have owed and try to give you time to pay them. Don't try to run away.

The six years will commence from the date of your last payment. If you are subsequently allowed back would be a question for the Home Office.
