Hi
This is a little long, but I need any information possible.

My husband and I went bankrupt in July 2009, discharged January 2010
My husband is on an IPA, ending August this year 2012.
We had read somewhere about a nil tax code for the period of bankruptcy. My husband continued to pay tax for that period of time, and no new tax code was implemented.
In the process of looking to remorgage to cover buying back our interest in our property, my Husband sent in his tax return.
The tax man has now written back to us stating that a nil tax code should have been implemented, but as it wasnt, they are refunding the tax paid for the period July 2009 to April 2010 to him.
This sum has today gone into our bank account.
My question is, does this belong to us ?
From what I have read, the trustee should have claimed this in the IPA during the period of bankruptcy.
The amount re funded would help if we need to look for alternative housing, in the event we can not remorgage.
I need clarifaction on how we stand with this, as we DO NOT want to do anything wrong.

So should my husband inform them, or will the tax do so. Or do we leave it where it is untill they ask for it ?

Sorry, but I am very confused, I cant understand why it came to us in the first place if it belongs to the bankruptcy.
