Can I ask please? what happens to things like phone line and broadband? Do they get stopped or taken away?

Is it everything gets closed down so the line is drawn? I already have a bank account deigned for such circumstance so I am hoping that would not be shut down

You just carry on as normal with your landline and broadband. Make sure you open a bankruptcy friendly bank account. Co-op Cashminder is recommended.

The bank Viki recommends is excellent - if the one you have opened is either HSBC or First Direct then be warned that they will close it down if you go bankrupt regardless of whether or not you have debt with them.

Thanks for the reply Viki,

I have a basic cash card account with barclays. It does have chip and pin but that's it. Nothing else. It's the same process as the Co-op one and is the same product in essence

I had a current account with First Direct before. I rang them up to see what their view was on an IVA when I was considering it before (only considering it) and I found out as they shut my account within the hour and I had £700 on my OD which they are now chasing me for.. I guess through their own actions they are stuffed.

Barclays should be fine.

HSBC and First Direct are a nightmare - it's awful that they close accounts. Makes you feel like a criminal!!

I know - I only said I was thinking about it - But now they shot themselves in the foot!

Can I ask one more thing please?

My credit file shows the Mortgage balance as closed so not actually showing as owing. However I have letters from the asking for payment.

My ex wife's solicitor now wants to do clean break and discuss finances. Does this happen even after bankrupcy?

I have the forms and the fee sat here ready to go. Just need to ring up and inform them of my intentions and then go down there and do it..

::edit:: another thing I have just thought of.

If the judge decides I can't go bankrupt is the fee kept by the court?

There is no reason why the judge would refuse your petition if you are insolvent. If they did though then I believe the fee would be kept.

Has the house been sold or repossessed? If so then any shortfall will be included in the bankruptcy.

you can stil sort out the divorce assets after the bankruptcy, in essence though it isquite simple because everything you own now belongs to the trustee so the inly likely point of contention is likely to be over pensions and possibly any childmaintenance

Hi Jan,

Yes there's 26K owing from the house and a secured loan which was on it. With all my personal debts it comes to the figure that I mentioned

Well ive got my appointment date and time. It's in my old court. They will use my address at the time as a C/O address (because I resided there for more of the last 6 months than here. But will the C/o address be the one listed on the register or will that be where I am now?

Does it matter if it's theirs? does it affect my parents? I hope not.

It won't affect your parents at all as long as you don't have any joint lending or savings with them.

Your current and previous adressess will go onto the insolvency register.

Good luck for your court date, please let us all know how you get on.

Thanks Viki,

I'd rather do it this side of the pond but I guess it's quicker this way. Shame theres no quicker way but ill just hope that my token payments mean something.

I don't have any financial links with my parents at all. I've also applied to take my ex wife off my file too - even though she will bear the brunt of the joint debts I am sure.

Unfortunately you won't be able to remove your ex from your credit files if you have joint lending.
