Hi, im 8 months into my bankrupcy now but today ive received a council tax bill for £191 from 2 years ago so my question is, can it be included in my bankrupcy at this stage? or can i pay it if im able? just to save bothering the OR as i feel ive mithered them enough lately over creditors still contacting me. Since council wasnt a creditor listed in bankrupcy, Am i doing anything wrong in paying it and will OR find out? Thanks Anna

Hi there

If the debt was outstanding as at the date of the bankruptcy order then it is covered by the bankruptcy. Just send any paperwork you have received to the OR marking it 'additional creditor'. I would also, if i was you, write to the Council stating quite simply that you were made bankrupt on....at....County Court and that you have forwarded the letter to the OR to deal with.

You can get into trouble for paying one debt over another and should not do so under any circumstances. (Your bankruptcy basically removes any debt from you name and as such you cannot repay something you do not owe - on themaking of the bankruptcy all your debts go into the name of the OR)
