 Hi i was wondering i think i might of forgot a creditor on my bankruptcy

Hi i was wondering i think i might of forgot a creditor on my bankruptcy and this was about 6 yrs ago as it does not show up on experian now. I went to get credit today and i was declined so i signed up for experian again and there seems to be still a default payment which has been updated in april this year 2012. This card was at my parents address and i have not received any letters from max recovery did i miss this when filing for BR if so what can i do.

If the debt was before your bankruptcy, then it is still included.

You need to contact the creditor and ask them to show it as satisfied.

Hi brascoe1

If you forgot to mention this creditor on your bankruptcy application form this does not matter. They are still included in the bankruptcy. You should contact the creditor involved, tell them that you were declared bankrupt 6 years ago and ask them to change the date of the default notice to the date of your bankruptcy. They are obliged to do this under the data protection act.

First of all thank you for the quick reply. Ok a rang max recovery and they know that i went BR and all i have to do is photocopy them my discharge papers and a screen shot of my credit report and they will sort it out. I have one more problem i didnt see the one from capital one although it says satisfied it still says default i rang them and said is it possible to change it to satisfactory and she said no cause your still in default and this will be on your record until 2014 and i dont know how you got away with being discharged early which i thought was quite rude. Anyway is this right in what she is saying?

Hi Barry,

You need to write to the Data Controller at Capital One and enclose a copy of your discharge and ask them to amend the default date to the date of your bankruptcy, it should then drop off your file six years from that date.

Send it recorded and keep a copy.

I was told you didn't get anything from the OR or any acknowledgement so is this just a copy of the register?

If you get an early discharge you get a letter form the OR with your discharge date. If you get an automatic discharge you dont get an automativ letter but if you ask the OR they will usually sort one out for you.

Neither of these is a certificate of discharge which can only be obtained from the court and is the absolute prrof of discharge, it does cost for most people though so only worth getting it if you really need it

What you need to do is check the register and as soon as you are discharged then print this off.

If you don't then it will cost you - I believe it's about £70 at the moment.

So do i need to find my case number or can i go straight to the court where i filed for BR and they can give me my case number there. Also will the cert be given to me there and once i have paid or do i have to wait for it to be sent to me.

You'll need to give the court the full details of your BR - date, BR number etc. You will need to call the court as, if I remember rightly, it's not as simple as turning up at the court and walking out with the certificate. I seem to remember someone saying it will be sent to you. Better to check though.
