Hi I am being investigated by HMRC for unpaid income tax to a total of over £90,000 . I dispute this and am appealling as it was my estranged wifes earnings which I now suspect she failed to declare. I have no proof though as it was mainly cash into my bank account over a four year period . Its a very messy divorce so I won`t be able to have her verify that it was her earnings especially as she has clearly failed to pay tax on it as HMRC are still expecting me to pay . If I am still liable for the tax I have no option but to file for bankruptcy .What I need to know is if I am living with someone (new partner) renting together how does the OR view them and their income . I am assuming I would be allowed to contribute towards the joint living costs ie rent , food , car etc as they are unemployed at present .Would the OR deem it reasonable for us to be renting a two bedroom flat together or a house ?If I was solely paying the rent on a two bedroom house or flat living with someone would OR allow me to continue paying that amount once Bankrupt if I was living with someone .Would OR allow me to continue renting two bedroom place if living alone ?. My partner is worried what financial implications they are for her if we are living together if I am Bankrupt . ie are her earnings taken into account or any income she receives ie benefits if she is unemployed etc . Also can the OR or HMRC look into her finances if we are financially linked if renting together and running a car together etc . Would it be better for her for us to renting seperately and not living together ? |

Hi confused1, welcome to the forum.
You don't need to live seperately if you declare bankruptcy.
I presume she is claiming benefits whilst she is unemployed so you will state that on your statement of affairs and then you put all the household expenditure down. If she gets a job, then you will need to inform the OR, only to show that she has a bit more to contribute to the household bills.
If you own the car, how much is it worth? and what do you use it for?

....and to answer your question regarding the property you are living in, it depends on the rent you are paying. If a single lady with no kids is renting a 5 bedroom house/flat for way more than a 1 or 2 bed house/flat in the area then the OR won't allow all of the rental payment in her expenditure. It's all based on personal circumstances, family needs etc.

Hi Viki, The car is owned by her I am at present just helping with the running costs.I don`t own a car myself . I am retired on an occupational monthly pension . I don't know where in the country you are, but that seems reasonable rent to me.
If you can't prove the need for a car, then the OR may not allow your contribution towards the car costs.
