 Trustees tried to sell my home 2 years after BR

The trustees tried to sell my home this year, 2 years after my bankruptcy, which runs out 1/9/12. They have applied to court to get us out saying we have been unco-operative, far from the truth and we think that this is to cover their c**k up.....

Hi and welcome to the forum. The trustee has 2 years and 3 months to value your house and can retain and interest in it for 3 years from the date of your BR.

Can you give more details of the problems you've had so the experts can advise you?

Last IPA payment made on 28th June 2010 and I'm now looking forward to getting married in September 2012 - I'm proof that you can go BR and come out the other side.

I found this very interesting, as I have a feeling this could happen to us as a "buyer" was found, but they apparently haven't got their funds together (allegedly private funding). We've co-operated all along, but as the 3-year period is almost up, I think the Trustees will try to force our hand. We've nowhere to go, as we're having difficulties trying to find somewhere/someone who will accommodate us, pets and grandchildren.

Hubby wasn't BR, but they don't seem to be taking that into consideration. I would be interested to learn the outcome of the original post.

Hi Bear Hi Andrew

firstly if you have significant equity within your house. The OR / trustee will chase the BR share of the equity.

They normally offer the trustees share to a third party (a distant family member or non BR partner) at this point they will be undertaking a desk top valuation of the property. This is totally unfair as it is based on the post code and other like properties that have sold in the area over the past few years. occasionally they will arrange a visit and obtain a thorough valuation.

you must obtain as much information as possible to negotiate why you feel this dsk top valuation is inaccurate. do not just sit back and expect the OR to be understanding, if you do not open lines of dialogue they may think that you are being beligerent and will default and start to take
court action.

NOW negotiate like crazy. The OR to be blunt just wants some money, they do not want to make you homeless but will do so if a compromise cannot be reached.

I have two of these situations that i am currently dealing with the first we managed to negotiate down from 150K to a settlement of 18K . The second is ongoing but our starting figure was 240K and we are aiming to show that all of the figures are wrong and we are not going to pay anything.

I would however put plan B in place and go and speak to your local council and ask to be put on the housing register.

I have not posted for some time but previously "housing" had typed a great guide for those facing issues like this, i am sure one of teh more regular posters will provide the link if it is still available
