 I'm in a terrible state, worried sick that the OR will be really angry with me for what I've done

I'm going to see my solicitor on 22nd aug to sign an amended SOA to go BR but i'm on benefits which are paid into a co op cashminder a/c, my partner left me last year & iv'e been trying to cope on my own but stupidly took out 4 payday loans to help me through, ive been paying what i can off but will still owe £200 by the time i go to the solicitor, a friend wants to give me the money to get the debt cleared but the reason i've been paying the loans off is because that is the only a/c i can use for benefit payments, i wasn't working when i took them out in desperation, what i wan't to know is do? Do i lift all the money out of the c/op a/c & try to get a pre paid account for my benefits, continue paying, let my friend pay them off or what? i'm in a terrible state with worry, panic, not sleeping, i've mental health problems with all the stress & am worried sick the OR will be really angry with me for what iv'e done,i know i was v v stupid but when you're desperate!!! Can anyone help?

Hi Holly,

If your friend wants to pay the payday loan off, then there is nothing wrong with that, as long as he/she doesn't want paying back.
Otherwise this will go into your bankruptcy.

If you took out credit knowing you were going bankrupt, then this will be frowned upon. But if you were just trying to get by with the payday loans, hoping things would get better, and they didn't, and now you are having to go bankrupt, then I wouldn't worry.

Hi Viki,
thanks for your reply but i am in a bit of a rut re my bank account, i have 2 payments due out this friday 16th aug, my friend can pay the rest off next friday, do i let the payments go through my account or what as i will be unable to open another bank account so quick, what a mess.!!I hope the OR's are sympathetic & understanding regarding peoples circumstances.

Have the loan companies got your card details? Is that how they take it? Or is it direct debit?

If it's direct debit, then cancel them.

If it's by card payment, then you would need to phone the Co-op and tell them you have lost your card, so they cancel it.

If possible, try and keep the cashminder, as it's a great account to have.

Thank you Viki, I'm going to a cash point now & withdrawing all the money,then i'l ring the co-op report the card lost, get them to cancel it, e-mail the companies involved tomorrow & tell them i'm going bankrupt & can't afford to pay them anymore, i think i authorised them to do continuous payments in case there wasn't enough money when they went to lift payment, will cancelling my card stop that happening? when i get a new card from the bank will the card/account number be different?

When you report a card as 'lost' the card company instantly puts a stop on all payments (including continuous payments)and cancels the card, they will then issue you with a new card which will have a different card number than your cancelled card and any payments you had coming out of your cancelled card are NOT applied to the new card.

Just rang the co op & theyv'e cancelled the card, the new card & pin will be with me in 3-5 working days,i told them my benefits were paid into that account but the girl said they shouldn't be affected as my account no will stay the same, but i'm going to phone them anyway to advise of the change as my next esa payment is due in my ac on 26th august & i need the money.

Hi Holly, I can confirm that the account number won't change, only the number on the card and the PIN associated with it. I lost my Cashminder card and they just replaced the card and the PIN.

Last IPA payment made on 28th June 2010 and I'm now looking forward to getting married in September 2012 - I'm proof that you can go BR and come out the other side.
