Hi all,
Its been just over the week since we had the court hearing and now in 2 1/2 hours I have my interview.
Like so many others I am nervous, I know that I have not been really bad, just trying to make the house better, then consolidating loans to make payments easier, then paying things off with remortgage, and using some to add an extra bedroom for the growing family. Then like many on here living on credit cards and overdrafts because a change of circumstances meant loss of wages and then well we get to this stage. "BANKRUPTCY"
I am so worried that the OR will say I am to blame for it all, after my operation I was not working for ages, mainly due to the fact that I had originally gone back too early and my mental state was not ready, i worked in a very hard job, lack of staff meant too much too do and I could not cope, I left due to stress, then just after a builder we had doing our conversion took us for a ride and what money we had put aside got eaten up, with many extras and we did not have enough to finish the job, I then had to reuse credit cards that had been paid off and scrape the bottom of the barrel in order to finish it off and get the house back.
It was just after this that I had the problems paying 2006 and then we had to go on reduced payments, taking money out of our food allowance to honour the payments the creditors had requested in order to keep them off our backs. We had not spare cash but i had to use my old catalogues to buy clothing, household items and gifts for the children at xmas, last money added on there Jan 2008 total added on both about 1800.
Now i feel that I will be punished for this mistake. We were paying and in full up until the end of 2006 and now i just feel so guilty that i had to do this.

Hi Jo

I hope the interview all goes well... I go bankrupt on Friday and am dreading that despite the reassurances from other people so I can well imagine what I would be like waiting for my interview!

I keep telling myself what's done is done, you can't change it, can't go back (although we wish we could) so its time to move on, think about the future and deal with anything that comes up as it happens.

I'm sure we have all felt guilty at some point or another about the way we went about things, believe me I have spent many a moment getting angry and upset with myself about how stupid I have been. But I can't keep punishing myself forever, onwards and upwards as they say!!

Can I ask a really stupid question? If the OR feels that we are totally to blame for our circumstances, can they refuse to make me BR?

Meash, the OR won't refuse to make you BR. You are made BR by the judge when you go to court, so will already be BR when you speak to the OR.

If the OR feels that you have been reckless, you may get a Bankruptcy Restriction Undertaking (BRU). If you don't agree with this, they can then apply to the courts for a Bankruptcy Restriction Order (BRO).

Although they sound scary, they're not. They can last for anything up to 15 years (for the most serious cases) and all they are is a restriction of BR restrictions - no credit over £500, cannot work in certain professions etc. As Melanie Giles says, they are pretty toothless!

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.

Well all thats the interview over with. Quite helpfull not at all like judge and jury. My OR wants to wait till we have sent in new wage slips before they decide on what we should pay as the income will be reduced by then, some things she said we cant have mainly the mobile phones as we have a landline, but even if we end up with 200 or 300 paying back at least that will be it.
We have said we dont know if we want to buy the insurance policies back yet and as far as the house is concerned there is no one to buy the BI so we will leave that up to the OR and who ever else deals with it.
Still trying to keep hubbys car as its the only one we have, worth about 1200 and we need for hospital appt, shopping getting to and from work, so trying to get sorted out, but that should be about it now.
I know some of the I&E will be changed, i expected that but wont know to what until she gets our upto date slips.
Anyhow not as scary as i thought, from the hearing to interview 8 days.
Nearly all done now.

Hi Jo,

I'm really glad it went well for you today and it wasn't as bad as you expected. I'm going to be cheeky now and ask if you, as a regualr poster like myself (), would be so kind as to post your Income and Expenditure once you've had it approved. I know I'll definitely do it when ours has been approved, cos I think it's so helpful to other posters to see what's been allowed and what hasn't. I really hope you don't mind me asking and sorry if you'd rather not, I do understand.

Hi Ians,
Not at all, once i know what they will allow me i will most certainly place it on here and also in my blog.
I wont know for a while maybe 2-3 months about what we will be allowed etc due to the changes in income and she wanted to make sure that she had the correct information.
I found my examiner really nice, she was quite helpfull and did not make me feel stupid, she asked me mainly about the majority of the debts and hubby just some of his own single ones, he is just waiting to hear about his pride and joy but hopefully they will leave us with that one if not well so beit.

I dont know why they did not say if we could or could not keep the car she just said she would let us know.
If they get us to sell she mentioned buying the BI from the car, that depends on how much they want from it to if we can buy it back, I know they cant really leave us without one and i want to go back to work which will be on nights now so i will need the car to get there as there will be no public transport. We will just have to wait and see. I tried to remember exact dates, im nearly spot on with them, some were so long ago i cant remember them all but she seemed ok, I explainedd what i could and to the best of my knowledge.
Now its out of my hands and in theirs so we will just have to wait to find out what they will do next.
Anyhow good luck next friday, could it be you have a face to face cos your nearer to the office, i dont know really. We are quite a way away but saying that they could still want a face to face.
Oh i mentioned a BRU to her and she said they dont do BRU's they only go for BRO's. But she does not 100% know about ours yet she said she would tell us once she had looked into it more otherwise we will be discharged 4/8/09.

Hi, I am only just starting to look at the BR route as I have had my initial IVA rejected by NR. Thanks for taking some of the mystery (and horror) out of the process. I still don't know if it is the right way to go, but I have my children and hubby to consider in all of this. As the debt is all in my name how, in basic terms, would this affect my hubby? Do they take into consideration his salary? car? etc. He has no other assests of worth

your husband's car is safe.
It's always less troublesome if all of the debt belongs to one party, so very much in your favour.
Yes his salary would be taken into consideration when you list the I&E details on your SoA.
But you do not have to put his total income.
Only that amount which he contributes toward the household expenditure.
