Im filling in my bankruptcy petition but wondered if i could possibly get answers to a few questions that the citizens advice bureau didnt give me.
I receive child benefit and asked them to pay me via a giro but they've said i have to get it paid into a post office account- wouldn't it get closed when i put the petition in?
also can i take my form straight to the court in te same day or do i need to make an appointment?
also i was advised to take all my money out of my accounts but wasnt sure when i should do this?
Hi re the post office account, before BR empty the account. After BR open a new bank account asap and either have your benefit redirected to the new account or check a week or 2 after BR that the PO account is still open.
You need to contact the court and ask if they have an appointment system or not. Most do but some have a walk in system.
Best to withdraw from any accounts the week before you go to court but remember you will have to explain what the withdrawn funds are to be spent on.
Hi Ide30, I opened my coop account after we went BR and then just before the court date had my child benefit put on hold till i could supply them with the new bank details as they would NOT issue a giro to me. The other benefits like DLA, Tax Credits and Carers allowance I get also sent through giros until i supplied new bank details and now im all sorted out. Our county court was Yeovil and we had to ring them before and get an appt for the day, she gave us a time and date and it could for us have been next day as they had a place but we did not have the funds to be able to do it so we chose a suitable date to do it on. We withdrew our last monies from our old account on the 31st of July and went BR on the 4th of August allowing all transactions to go through intime for the hearing. We wrote on the additional info sheet that we withdrew the funds to pay for the court fees, council tax and other general living expenses. Hope this helps JO
