|
hi there,
just wondering, when you go to court do you have to stand in front of a panel of judges or is it just one? any more details on these fine points would be appreciated.
also, roughly how long does the court thing take? |

andy,
Depending on which court you attend you may not see the judge at all. I have read many a post where you hand your paperwork in to a clerk, swear on the bible, then are asked to return at a certain time to pick up your BR certificate. Myself i did see the judge but was literally for 2 or 3 minutes and very painless. Never heard of anyone having to face a panel of judges. The time again depends on the court and how busy they are, i attended court at 10am and was away for 1pm.

ok, many thanks. that sounds a lot less frightening than what i thought.
what about the OR? a)where abouts does the meeting take place? b)how far back do you need to provide business/personal bank account records? c)how painful/lengthy is this part of the process? d)also, are they neutral,there to help you or otherwise?

Hi Andy, The OR is there to help you not treat you like a criminal. My OR called me after the court hearing and no i did not see the judge and informed me of what they wanted, this was the 2nd call as i had one of the same day as the hearing just to be introduced to them and be advised what would happen next. The OR called me on the Friday I went BR on the monday and made the main appt for a telephone interview, which was booked the following Tues. All mine wantedd was credit agreements, 6-12 month bank statements if I had them, proof of utility bills, proof car was insured and anything else that I had that would help with the case. My OR was very friendly and helpful and I did not worry when i had the telephone interview, I was not on trial she just went through the forms and asked when do we think we started to get into the mess that we were in, I know its on the form but they need this info to make up there reports to send to the creditors. We are now waiting to hear about the house as we wont be buying the BI in it and also if hubby can keep his car worth about 1200 as she was not sure. Other than that quite painless. My county court we had to call before and make the appt we were in there 1 hr 50 mins and that was that. Hope this helps Jo

I did have to see the judge, and he was fine. My OR was very efficient and business like, but quite pleasant and approachable.
