i had my OR interview today by phone,even though the OR said 30mins it dragged on for nearly an hour.but to be fair i did sort out my wifes BR with them as well as she is having trouble with her ms and didnt feel up to it.top marks to the OR who rang he was very polite and explained everything,i think i can judge the interview a success as all i need to do is return an i&e form when it arrives.
Bad new is that due to me having a lease car they wanted to repo the wifes car,which is fine as we were going to sell it anyway as it was on its last legs and getting unreliable hence the lease car.anyway an agent acting on behalf of the OR rang and wanted to know if they could pick the car up straight away,i may be BR but i'm not unemployed just yet they set a time of 7.00pm today,and it had to be today,tommorrow wasnt good enough but no reason why was given,other than the insurance had run out (the car is sorn'd and on my drive anyway)i got stuck in traffic on the way home,but i thought everything was ok as they hadnt rung,maybe they were stuck too? i rounded the corner into my cul de sac to be confronted with utter chaos.the agent had sub let the collection to a scrap dealer who had parked his truck broadside across the road blocking it,with part of his truck in someones front garden and they were winching my car onto the truck.bearing in mind the car was locked,handbrake on and in gear this was going to be hard and true enough it was hanging over the side of the truck.the driver shouted at me was i the bloke from number 6? i asked what the hell was going on ? he (still at the top of his voice) shouted "i'm reposessing your car" great now all the neighbours know !!!!! all the time this is going on his henchman are still dragging my car off my drive and onto the truck.i asked him what right he had to take my car off my drive which is in essence private property, an why hadnt they rang me " we dont we just reposess your car we dont need to cal you we just take it" i wasnt going to stand an argue,me plus decidely jittery not very well wife versus 3 grease monkeys, i may be good but not that good. i managed to get them to stop while i removed my personal belongings from the car and left them to it.
question. i was not aware that they could take items if i was not there, i thought they could only do that on the second visit,this is obviously the first.any one know? i will certainly be speaking to the OR office on friday as this is disgusting ,they were rude and i doubt they could even spell discrete, although they might be able to shout it. |

Hey Bluey,
That sounds pretty nasty too. I hope you give the OR what for, I know they are doing a job but that to me sounds like you have said disgusting.
My car which was 2 years old was take a few weeks back before we went BR and so technically it was not repossesed as we asked them to take it, we have one vehicle left worth about £1100 and we are wating to hear if we can keep that.
Let us know how you get on with the phone call.

Hi Mark,
I would have thought they would. We just wrote to our company which was Santander and explained that we could not afford to pay them anymore, also that the car had gone to sorn and was uninsured. They were asked if they could come and collect it asap as it was devaluing everyday and I wanted the car out of the way. About a week after the letter was sent I had a call to arrange collection, then 3 weeks later they came and collected it, I took photos of them taking it and also posted the part on the V5 to the DVLA with a copy of the collection note on a recorded deivery that same day so I had proof it had gone and to get my name removed so I was no longer liable. I have heard nothing back from the company and they took it the 14th of July, I added the car to the SOA and explained to the OR what we did and she is looking into it, but seemed ok about it, it is now out of our way and we told her we thought we were doing what was right at the time. The car went to auction and like i said we have heard nothing about the car what so ever so i would say go for it. Just get your photos and other correspondance to show the OR if needed. Also take a copy of the V5 for your own records too and take lots of the van to show no damage etc. Thanks JO

right ,i've just chewed the OR's ears off about this,they havent a clue and referred me to CAB. does anyone here know civil law? my local cab only opens odd hours and i cant get there without taking time off work. any help is most appreciated. |

I don't think you have any recourse in law regarding this, although it does seem to have been handled poorly.
The car is the property of the estate, which is controlled at the momenet by the OR, and so in effect they are retrieving their property. As long as no damage was done to any one elses property while they were doing this they have broken no law that I know of. I would be very interested to know if anyone has a different view.
