hi,
is there anyway of keeping some of my hubby isa instead of giving to the OR. We are going BR on 9th Oct and i am using 1000 of it to pay for the 2 Brs of me and hubby and wondered if the other 2K could be saved at all. i know i am being greedy but would like to know your thoughts.

Hi Tracy

Not sure on that, as it is classed as an asset then the OR may want it.
As your both gping BR then i assume that the OR will take it all to pay towards your creditors.
That is unless you need some essential items beforehand like a washing machine or hoover.

Thanks Jo for your comments. Hoover blew up yesterday and i was unsure if i was allowed to buy another one but posted it and got several replies, saying it is a necessity so i could get one. Its so nice to know that there are people willing to help others at a time like this. Phoned court this morning to get forms and she said to book in now as the list is so full. got a cancellation for 9th Oct. It seems so real now got a date. just wish i could sleep!

I would say with 99.99% certainty that you will NOT be able to keep this money. It is an asset the same as if someone had £2000 equity in their home they would be made to hand that over!!!

I'm afraid I agree with the others that this asset will need to be vested in the OR who will realise it for the benefit of your creditors.
