I have just phoned the local court who have told me that the earliest date to go there for BR is...... 29th September!!
Cant wait this long, how would it work if I went to another court. I have read somewhere about going to London and you canbe seen the same day.
Any advice would be appreciated. |

Hi Harbourmaster,
You do need to go to the court local to where you have been living for the last 6 months. It may be worth talking to them again as it's not unusual for cancellations to occur!

| The joys of living in rural Wales!! Got Caernarfon Court to acceptthat I live in thier juristriction and now got a date of 10th Sept. (Next wednesday) Still trying to investigate how it works with the London courts. |

I have long been under the impression that anyone could go to the High Court in London, and technically I still think that's how it is.
However, I recently needed to get a client into BR as she was just about to have a charge put on her property by a creditor. I had 7 days to get her in.
The local court (good old rural Wales again) couldn't help for 5 weeks but when I called the High Court they said no.
In my opinion they may have an internal policy to do this whereby they can to lighten their workload but not sure where to go to prove it.
Anyway, I called the Welsh court again and explained that my client wanted her assets to be shared out by the OR equally to her creditors rather than have the charge land for that one creditor to take it all (absolute rot of course!!!) - the local court squeezed her in with 2 days to spare!!!!
So how was it originally 5 weeks?????

I should be able to keep the "enforcement officer" out of th ehouse for another week!!!
Think they may have paid a visit to us tonight, we have only had 3 strangers ring our doorbell in the last year as we live quite rural! but tonight a starnge van with a company name on the side parked and was quite persistent with the doorbell. Checked the company name out on the internet and cannot find anything!!!! We were both upstairs still completing the SOA's so didnt bother to answer.
Do they usually go "undercover"? |

Do you not have a shotgun licence as you live rurally???
I don't mean use it of course, or aim it at them, just act as if you are oblivious to their arrival and parade around the house with it when they are coming up the driveway.

An enforcement officer is appointed by the High Court. A Bailiff has to give 7 days notice of thier intention to visit. An enforcement officer doesn't!!
We were taken to the High Court without our knowledge (long story)had a high court judgement registered on 29th July for £46500 and they obtained a writ of fi fa!! (nothing to do with football)tried to pay the debt in full but the solicitors would not accept it. Then found out that there were an additional £5000+ costs added on in 2 weeks!! They are still trying to sieze our property and th eonly way to stop this is to declare BR. That swhy we needed a quick court date. |
