Hello All,
Does anyone know if early discharge is common or unusual. I have been BR nearly seven months and I gently asked the OR whether I might be discharged early. The case officer I spoke indicated the investigation of my case was just about complete but did not really know if an early discharge was about to happen. I have not received an IPOQ as yet, though. I believe the OR must send this and get it back before an early discharge. Of course, I don't have the right to one but just would help to get over the strain of it all if I was discharged early. I don't think my case has been all that complicated and I have been sure to keep the OR fully in the picture. |

I have heard it lots of times where more and more people are being given early discharge.
Lets hope you do and maybe then there will be hope for me.

Hi pix, I know for a fact that my local OR office doesn't give an early discharge if you've used credit AT ALL within the past 12 months.

I have just received a letter from the OR asking for an update of my expenditure/income, etc (became bankrupt in May 2008). On the form it says I should respond within 14 days to be considered for early discharge (which i have done. One thing it does say is that I should not try calling the OR to ask about the progress of the discharge procedure as it may delay it. It also says that the OR will write to each of my creditors asking if they object to an early discharge. I dunno about that, but i'm wondering what any objections they could have. |

Pix1 - early discharge is normally only considered if assets can be/have been dealt with quickly. As you've not had anything for 7 months, i would suggest you will serve the full 12 months.
Zamfir - this is down to the OR's discretion. Which office are you dealing with as I've never heard of an OR taking this stance?
Antp - you've received the standard early discharge questionairre. Get it completed and back asap and you should be discharged in about 6 weeks. Writing to creditors is part of the process, and will normally only object if you used credit just prior to going BR. I wouldn't worry!

Can you still get an early discharge even if you have a property with equity that the OR will want to release after the discharge date? Thanks

So we still could get an early discharge, even though the property we are in will still be with us until the OR wants to sell it on. That is providing there is equity still, at the moment there is £15-18k but we wont be buying the BI in it, we just want to let the OR deal with it how she wants to. I will keep you posted, but all we have had paperwork wise so far is the IPA for the Zero Tax Code.

Would you get early discharge if house is included in BR and no other assets to deal with (apart from number plate) Unlikely to get IPA due to income.

I am in the same boat as you as like you i have the house and also the cherished plate. The plate is now sorted the OR have cashed the cheque but i have not heard anything about our home as of yet only the IPA for the NT Tax coding. I asked that question before and as told to me its up to the OR but not unheard of. Good luck.

I spent £500 on credit cards in march this year which i used to pay br fees plus buy a new fridge and i got early discharge on the 8 sept so it all depends on your or.
I was never sent a letter asking for an updated i&e but i had told them previously that i was getting long term incapacity benefit. |
