I have a had a letter from Mercers debt collectors today with regard to my outstanding debt arears with Barclaycard. I have also had a letter from pay2connect saying they intend paying me a visit. I can see a queue forming at my door before much longer. I am going bankrupt on 20th October as that is the earliest date I can get at the moment. They say I have ignore all telephone calls to my home which is true, but they have been contacted by letter, so I have not ignored the situation.

The debt is all mine but I live with my mother who is 76 years of age and suffers with her nerves. She does not want to be troubled with telephone calls and especially not debt collectors knocking on the door.

I have sent these debt collectors a letter informing them that I will not deal with my debt on the doorstep and they will be held responsible for any distress this may cause my mother if they call while I am out. I have also made them aware that I am familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970.

Do any of the experts think that by telling them this that it might put them off. I am more worried about my mother than anything else and do not want her to be hassled by these collectors. If they come while I am in then I will just tell them to go away, but my mother would not be so abrupt as me and would get confused.

Any thoughts on this

Hi debtrider

once these letters arrive it is usually a few weeks before they arrive IF infact they actually come.

They have no legal ability to take anything from you and are legally not allowed to discuss your provate affairs with your mother.

I suspect that the best thing would be to give them the date of the Br and they will usually leave you alone and request confirmtion after the date.

This can be done by post / fax
