i went bk last thur..the court was not the ordeal i expected (read my previous post) i didn't even have to see the judge and this was the worst thing i was dreadying.

Afternoon

Well, here are todays proceedings.

We arrived at Ipswich County Court at 0910 hrs for two appointements of 0915 & 0930.

We were sent to the Cashier who went through 1 set of forms each and threw the other 2 copies away.
We swore on the holy book etc then paid our monies.

Time 10 mins.

We were then told to go to the court Usher as we will be seeing the judge at 1000 hrs.

We went upstairs, we were the only people in the room, no usher for about 10 mins. When she arrived she took our forms and came back from the judge and said he would see us on time (1000).

We went to see the Judge together, he asked one question about the possible shortfall in the house.

Time 5 mins

He then adjudged us both bankrupt and sent us back to the cashier who advised us to come back in 20 mins to collect completed Petition.

We went outside for a leisurely walk around Ipswich for 15 mins then returned to the Court Cashier.

She gave us our Petition then advised us to go straight to the OR at the other side of Ipswich.

We went to the OR who would NOT see us together incase i was 'holding a hand behind up her back'??

He asked her some direct questions etc, how we got into debt.

Time 15 mins.

I then met the same OR, he asked me the same questions, then said things look OK at first glance and that we should be discharged after 6 months.

Time 15 mins

OH was then asked to enter the room, he said something which someone could maybe clarify that our tax codes will be set to zero and that we would have to pay all money above our SOA to him if we want!
We obviously agreed.

He asked us a couple of more questions and then said that we would have a telephone interview next week and as long as this was OK, that he would send us a form in 3 months to update any pay rises / changes in our affairs.

That was it, we walked out of the ORs office with a clean slate.

I cannot honestly believe how easy it was.

We have just called all our creditors, banks and Northern Rock to advise them accordingly. (out of courtesy)

That's fab, Matt, well done and congrats to you both on your debt-free future!! :-)

The OR's right about your tax being zero for the remainder of the tax year (till March). You will therefor in effect get that tax paid to you BUT you must keep it as it will be collected from you to go to your creditors.

Can you clarify again what he said about money above your SoA? Did he give you a figure you'll need to pay separate to your tax?

Glad all went ok for you . Things must work differently 'oop north' as we had 5 min call with OR in the court clerks office then got told we would get an interview date thru the post .

He said that the figure depends on IF there is any money left over our SOA.
I personaly couldn't find anything but i presume thats what he has to do. He hasn't confirmed agreement obviously to our SOA yet. This will change drastically due to us giving up the 1st and 2nd mortgage.
I know we can save c.300 by renting a house 2 bedrooms bigger than what we have now.

Is this what you meant ?

Hi Matt,

Yeah, that's what I meant. If there is anything left after all your expenses once you're renting though, they don't take ALL of it. They will take a percentage depending how much you are left with. Did he say all of it?

Hi C.

He told us that they dont take all of it, it depends how much was left so yes to your question.

His example was that if we hade £1000 spare over and above, then £700 of that would be for the creditors etc.

Obviously we dont have anything near that, he said in our circumstances it would be a lot less P in the £. but couldn't give us an indicative figure until he has assed all the I&E.
