we are more than likely to go bankrupt in the new year, by which time my wife will be out of employment for quite a stretch.
she is currently on maternity leave but isnt realisticly going to be able to go back to work for some time (we have 3 small children)
i was just wondering if my OR bases any payments we have to make on the income we are recieving at the time, then how long would my wife have to wait before returning to work without the OR payments increase? (seems pointless her going back to work in say....6 months if the OR is just going to take any extra income)

hope this makes sense

Hi again jwmc,

That will totally depend on the amount of your disposable income. If it's less than £100 each, then you shouldn't have to pay anyway. If you didn't have to pay an IPA during your bankruptcy period (12 months), then whatever your pay is after that time, you won't pay anything.

hi bc,
what im asking is: say after the br, the or decides to take nothing, then after 6 months/a year my wife gets a job.....what is likely to happen.

sorry to b a pain....

Hi again,

If the OR takes nothing at first, then your wife goes back and it gives you a disposable income, they will want a percentage of it, and payments will be set up. If no payments have been set up by your discharge date (12 months after your BR date), no payments can be requiested, no matter how much is earnt.

Hi,

I just wanted to say that it would be better to wait until after discharge for your wife to get a job...if she gets one 6 months into the bankruptcy then you may have to pay into an IPA for the next 3 years - whereas if she just waits another 6 months, then she can get any job she wants and no-one can take any money from you then!

Thats is also what im looking to do. That way i 1. Spend time with my family but 2. dont have the worry of working for nothing again.
