thanx mother hen and john for your reply, my mind is becoming more eased, but can they send in debt collectors or bailiffs to remove my furniture or demand cash as the latter i do not have, not looking forward to christmas this year, but hey things should work out. i have gathered the money of £335 FOR THE FEES FOR THE BANKRUPCY WHICH I INTEND TO DO NEXT WEEK AROUND THE 21ST OF OCTOBER. iS THERE ANYWAY THE COURTS CAN REFUSE MY APPLICATION? THE FORMS ARE FILLED OUT ETC BUT JUST WONDERING IF ANYTHING COULD GO AGAINST ME. |

Hi cb3,
The courts would only tend to refuse an application for BR if it is obvious you are not insolvent (if you have assets worth more than your debts, for example), or if it is clear you don't understand the implications of BR. It's something people often worry about, but from all the reading I've done, I've never heard of it happening.

Hi CB3,
I agree with BC that as long as your insolvent then there should not be an issue.
Again i have not heard of anyone being refused. Obviously if you have a house which hasa no mortgage worth about 150k and debts worth about 50k then yes you have a means to pay them as you could sell your house to clear your debts and go into rented, but other than that it would have to be extreme to be refused.

i have heard that sometimes your application can be refused if you have not sought good advice if, for instance, you have complex matters, the district judge will ask that before he signs the bankruptcy order. you must give a satisfactory answer or it's thrown out and your fee is down the pan. |
