I was self employed with a separate account for my business cheque to go in my husband and I are about to file for bankruptcy will my business account be covered by my file for personal bankruptcy or will I have to pay a separate fee for this. Also I have a 19 year old son living at home, will they be able to freeze his bank account too?

if the business is a partnership and either one or both of you plan to declare bankruptcy the account is likely to be frozen. If you are both declaring bankruptcy then any overdraft on the account will be written off.

If your business is a limited company the account remains unaffected as will your sons account, whatever you decide to do his money is safe.

Hi Angelam

I take it your wanting you business account to be included is that what you mean as for your sons no they wont touch that as long as you are not named on there.

A little bit more info on what you are trying to say about your business account would be good, but all accounts would be looked into if you file for BR but really if its also involving the business side of things then you may be better calling our helpline, the call is free and they can steer you in right direction as when it comes to business there may be other ways to help you out or other options available.

Hi thanks for your help and your comments. You asked for a little more detail about the business account. The business is in my name only for my self employment cheque to be paid into, I was advised to have the separate account, it is currently overdrawn, as I have this account and my joint account will the fee for bankruptcy include both accounts, I understand that as my husband and I are both filing for bankruptcy we have to both pay a fee, I am just hoping I will not have two fees to pay. Also I have recently filed tax return to be paid Jan 31st, can I include this as a debt or will I still have to pay this?

Hi Angelam

You both have to pay the fee which is currently £495 each as you cant go BR as a couple its as seperate people.

You may be able to get a reduction in the fee, you would need to contact your local court and ask for an application form and read it through to see if any applies to you to get a reduction.
