i have recently declared myself bankrupt.i sold my house last dec 07 and moved into rented property with my children after my husband left us. i had £5,000. equity from the sale which i owed family members who had lent me money to help pay towards the mortgage, house repairs and debt which my husband refused to pay.i also had to pay rent and a deposit in advance for the new rented house which my father lent me and i payed him back from the sale proceeds. the official receiver has told me they want this money back from my family. my dad is a pensioner who lives in sheltered housing and has no money and my brother has his own family and has financial problems too. can they be asked to pay this money to the OR?

Hi

yes I'm afraid they can ask.
If they cannot pay then you will likely receive a BRU/BRO for treating your family as preferential creditors.

So the upshot is explain to your Dad that there is nothing the OR can do to him. The OR can ask but Dad has no assets to claim so that would be the end of that. Your brother's situation would depend on his financial position but in the end if he too has no funds or assets then the OR is powerless to do anything but lay the responsibility at your feet by possibly imposing that BRU/BRO.
